Dear Dr. Francis:
The Commission issued Amendment No. 46 to Facility Operating License No. R-28 for the University of Michigan Ford Nuclear Reactor on December 12, 2003. Your letter withdrawing your request for Amendment No. 46, Elimination of Limiting Condition for Operation 3.4.4, dated December 10, 2003, was received after the amendment was issued.
Since you have permanently ceased operation, Amendment No. 46, as issued, has no substantive affect on your licensed activity. Therefore, the staff intends to allow Amendment No. 46 to stand and concentrate resources in the review of your application for Amendment No. 47.
