Re-submittal of Previously Submitted Documents for the Davis-Besse Nuclear Power Station.
Ladies and Gentlemen:
By letter dated October 4, 2002 (RAS 02-00534), the FirstEnergy Nuclear Operating Company (FENOC) committed to resubmitting corrected copies of four documents with duly authorized oaths or affirmations. FENOC stated that, in preparing these re-submittals, the completeness and accuracy of the previous submittals would be re-verified and any inaccuracies corrected. By letter dated November 7, 2003 (RAS-03-00602), FENOC updated this commitment to re-submit these four documents in addition to three other similar documents that were discovered during an extent of condition review with duly authorized oaths or affirmations prior to restart of the DBNPS.
Attachment I to this letter identifies the disposition of each of these seven documents. Where possible, documents were verified to be complete and accurate as originally submitted. For these documents, new affirmation pages are included in Attachment 2 documenting the accuracy of the specific document. Based on further knowledge of the correspondence, the subject activity described in one document is no longer applicable to the DBNPS, and another document was superceded by later correspondence. For these two documents, there is no longer a need to verify the completion and accuracy of the original submittal. Finally, two of the documents pertain to the degraded reactor pressure vessel (RPV) head, which was subsequently replaced with a new RPV head purchased from the cancelled Midland Plant. These documents are no longer applicable to the current DBNPS, and one of these documents was identified as containing incomplete and inaccurate information by the Nuclear Regulatory Commission in the DBNPS Augmented Inspection Team Follow-up Special Inspection Report No.
50-346/02-08(DRS). Therefore, FENOC will not be validating these documents and will not be resubmitting these documents under oath or affirmation. Further details on the disposition of 4oo(

Serial Number 2685 The information in this document was verified to be complete and accurate as part of the expanded scope of the 10CFR50.9 review project as described in Letter Serial Number 1-1330 dated October 24, 2003. A duly authorized affirmation page for Letter Serial Number 2685 is included as part of Attachment 2.
Docket Number 50-346 License Number NPF-3 Serial Number 2830 Attachment I Page 2 of 3 Serial Number 2727 On December 20, 2002, the FENOC submitted Letter Serial Number 2823, withdrawing License Amendment Request (LAR) 97-0007. Since this LAR has been withdrawn, there is no need to validate the previously submitted information and execute a new affirmation that the statements in submittal Letter Serial Number 2727 are true and correct. No further actions are necessary.
Serial Number 2735 This document pertains to the degraded Reactor Pressure Vessel (RPV) head, which was subsequently replaced. As discussed in NRC Augmented Inspection Team Follow-up Special Inspection Report 50-346/02-08 dated October 2, 2002, the information contained in this submittal was not complete and accurate. Therefore, this document will not be validated and will not be resubmitted under oath or affirmation.
It is noted that since Serial Number 2735 was submitted, extensive correspondence between the DBNPS and the NRC has occurred in response to NRC Bulletins 2002-001, "Reactor Pressure Vessel Head Degradation and Reactor Coolant Pressure Boundary Integrity" and 2002-002, "Reactor Pressure Vessel Head and Vessel Head Penetration Nozzle Inspection Programs" as well as in response to the Order Establishing Interim Inspection Requirements for Reactor Pressure Vessel Heads at Pressurized Water Reactors (EA-03-009), which has described FENOC's plans for periodic inspections and examinations of the new RPV head for the DBNPS.
Serial Number 2745 This document also pertains to the degraded Reactor Pressure Vessel (RPV) head, which was subsequently replaced. As discussed above in reference to Letter Serial Number 2735, the degraded RPV head has been replaced with a new RPV head, and therefore Serial Number 2745 is no longer applicable to the current DBNPS. Therefore, FENOC will not be validating this document or resubmitting it under oath or affirmation.
Serial Number 2761 This submittal documented Reactor Pressure Vessel Head examination plans for the Thirteenth Refueling Outage at the DBNPS. These examinations have been completed, and led to the discovery of degradation of the Reactor Pressure Vessel Head. Since these activities have been completed, there is no need to validate the previously submitted information and execute a new affirmation that the statements in submittal Letter Serial Number 2761 are true and correct.
Future examination plans for the new RPV head were subsequently documented in response to NRC Bulletin 2002-002, as well as in response to the Order Establishing Interim Inspection Requirements for Reactor Pressure Vessel Heads at Pressurized Water Reactors (EA-03-009).
