REQUEST FOR EXTENSION OF TIME TO FILE PETITION FOR LEAVE TO INTERVENE IN PROCEEDING ON DOMINION NUCLEAR NORTH ANNA, LLC.,
APPLICATION FOR EARLY SITE PERMIT (ESP) FOR THE NORTH ANNA SITE Gentlemen:
This is in response to your requests for an extension of time to file a petition for leave to intervene in the North Anna ESP proceeding, which you made at the December 8, 2003, public meeting on scoping for the environmental impact statement (EIS) that the staff intends to prepare on the application. The NRC staff, in any event, lacks the authority to entertain such a request in this instance. The time to file a petition to intervene is governed by the provisions of 10 C.F.R. § 2.714(a)(1). As stated at the meeting, for the proceeding on the North Anna ESP application and in accordance with the notice published in the Federal Register on December 1, 2003, (68 Fed. Reg. 67489) that time expires on January 2, 2004.
