RESOLUTION NO. 05-2003 A RESOLUTION IN SUPPORT OF THE RESTART OF DAVIS-BESSE NUCLEAR POWER PLANT AND DECLARING AN EMERGENCY.

WHEREAS, the Nuclear Regulatory Commission 0350 process to evaluate the readiness for restart has been a good process and will continue to effectively evaluate Davis-Besse after restart; and WHEREAS, Council has been assured that the plant condition is better than it has ever been; and WHEREAS, Council has been assured that the employees are working hard to make sure this never happens again; and WHEREAS, the continued oversight after restart by the Nuclear Regulatory Commission and their willingness to involve and keep the County involved is definitely important; and WHEREAS, FENOC agreeing to a closer working relationship with Ottawa County through County Administrator Jere Witt being appointed to the Restart Overview Panel and the Company Nuclear Review Board as an independent oversight; and WHEREAS, the economic impact of the Davis-Besse Nuclear Power Plant is vital to the com-rmnity mcl thercfae, Gomcil has detem!x$ that t h i s Resolution shall be an emergency measure, and as such, it shall take effect immediately upon its adoption and due authentication by the Mayor and Fiscal Officer, respectively; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF OAK HARBOR, OTTAWA COUNTY, OHIO:

Section 1. That it supports and encourages the safe restart of Davis-Besse Nuclear Power Plant.

Section 2. That it is found and determined that all formal actions of Council concerning and relating to this Resolution were taken in meetings of Council, open to the public, and that all deliberations of this Council and of its committees, if any, which resulted in formal action, were taken in meetings open to the public in full compliance with the applicable legal requirements, including sections 121.22 of the Ohio Revised Code.

Section 3. This Resolution is declared to be an emergency measure for the reasons
