Discuss/Approve Todays Agenda The Panel approved the agenda, but modified the order of presentations. THE APPROVED AGENDA REFLECTS THE ORDER LISTED IN THESE MINUTES.

Discuss Plant Status and Inspector Insights and Emergent Issues List Mr. Thomas briefed the Panel on the plant status and discussed the two systems work critical path items: HPI pump modifications and electrical distribution breaker coordination efforts.

Discuss New Allegations and Determine Whether Any Are Required to Be Resolved Prior to Restart Mr. Phillips informed the Panel that there were no new allegations.

Discuss Any Allegations for Which an Extension Was Requested Mr. Phillips informed the Panel that there were no allegations for which an extension was requested.

Discuss Communication Status Mr. Stang led a discussion on the standing rules for addressing communications from outside the agency. Mr. Ruland requested adding the allegation or other regulatory process to the rule list. The response to the 1000s of letters mail merge effort is proceeding as planned. The Comm Team schedule for upcoming meetings was reviewed.

Discuss Results of Public Meeting at Headquarters on HPI Pumps

3 Mr. Terao briefed the Panel on the morning public meeting held at Headquarters on the HPI pump design/modification issues. According to the MPR presenter, the major design modifications have been completed and sufficient engineering has been done to allow for resolution of the issue. The presentation will be available on the NRC web site shortly.

Discuss Punch List Mrs. Lipa discussed the updated Punch list milestones and lead assignments. This updated list will be forwarded to Mr. Mendiola for comments and the list will be issued to Panel for schedule discussion at next weeks Panel meeting.

Discuss Process Plan Mrs. Lipa led a discussion on the status of the Process Plan. No significant changes were noted.

9.

Discuss Action Items The Panel reviewed the following open Action Items with comments as noted:

Item 73 (Closed) - Send feedback form on IMC 0350 procedure to IIPB. (08/06)

Provided detailed comments to R. Frahm on 10/16.

The Panel determined that this item is Closed.

Item 178 (Open) - Determine the type of backlog assessment that will be performed and by whom. Two attributes need to be considered: (1) the capability of the licensee to manage the backlog in an operating environment; and (2) the impact of the backlog on equipment reliability. (03/04)

Inspection Plan will be to Branch Chief by 10/23/03 and finalized by Panel 10/28/03.

Item 193 (Closed) - Consider TIA on an issue pertaining to 10 CFR 50, Appendix R, Section III-L, "Alternative and Dedicated Shutdown Capability." (05/27)

Final draft TIA sent to A. Mendiola and thereafter will be tracked under Action Item #216.

Item 216 (Open) - Submit a TIA which addresses issues and questions related to the licensees 1991 10 CFR Appendix R exemption request regarding Alternative Shutdown (ASD) regulations. (10/02)

The draft TIA has been forwarded to A. Mendiola, and this item will remain open until TIA is finalized.

NEW Item 219 (Open) - Brief Jim Caldwell on how Immediate Action Maintenance issue was resolved. He would like to see the revised procedure. (10/21) 10.

Discuss Items for Licensee Weekly Call The following items are proposed for discussion during the licensee weekly call on 10/22/2003:

Confirm revised date for the Restart Overview Panel meeting on 12/02/2003; Confirm onsite dates (week of 11/17/03) for the Backlog Inspection Team; HPI pump modifications and installation timelines; and Breaker Coordination revised work scope/completion timeline.

Discuss/Update Milestones and Commitments The Panel reviewed and discussed upcoming milestones and commitments. The suggestion was made to include Key NRC Restart Milestones to the list, i.e., restart decision, EDO briefing, regulatory footprint issuance.

J. Stang A concern was identified for the shutdown function performance goal of maintaining reactor coolant level. An NRC safety evaluation report issued in 1991 apparently allows the licensee to maintain reactor coolant level above the top of active fuel instead of maintaining level within the range of indication in the pressurizer; 7/1-John Hannon to determine if a TIA is necessary or the issue is moot.
