Completion of NRC Order (EA-03-038) for Compensatory Measures Related to Fitness-for-Duty Enhancements Applicable to Nuclear Facility Security Force Personnel for the Perry Nuclear Power Plant Ladies and Gentlemen:

By letter dated April 29, 2003, the Nuclear Regulatory Commission (NRC) issued an Order (EA-03-038) for Compensatory Measures Related to Fitness-For-Duty Enhancements Applicable to Nucleari Facility Security Force Personnel. On June 2, 2003, and July 24, 2003, the FirstEnergy Nuclear Operating Company (FENOC) submitted responses (letter numbers PY-CEI/NRR-2713L and PY-CEIINRR-2720L) to the Order for the Perry Nuclear Power Plant (PNPP). By letter dated October 23, 2003, the NRC subsequently granted relaxation to the Order, specifically addressing the exclusion of shift turnover time from the group work-hour average and the use of the 60-hour per week average when conducting force-on-force exercises.

In accordance with Section III.C.2 of the Order, this letter provides notification that actions taken by the PNPP to achieve full compliance with the Compensatory Measures as described in the PNPP submittals identified above, as well as the relaxation discussed in the NRC letter of October 23, 2003, were completed by October 29, 2003.
