REQUEST FOR INFORMATION REGARDING ENDANGERED SPECIES AND CRITICAL HABITAT FOR THE RENEWAL OF SURRY INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Mr. Davis:

The U. S. Nuclear Regulatory Commission (NRC) is considering amending Virginia Electric and Power Company (Dominion) License No. SNM-2501 to authorize the renewal of the Surry Independent Spent Fuel Storage Installation (ISFSI) located in Surry County, Virginia. By letter dated April 29, 2002, Virginia Electric and Power Company submitted an application for the renewal of the Surry ISFSI License. An applicant for a license of this type must submit an environmental report as part of its application, as required under 10 CFR Part 51 of the NRCs regulations. The NRC staff reviews this information in accordance with the requirements of the National Environmental Policy Act, as specified in 10 CFR 51.10.

In conjunction with our environmental review of Dominions application, the NRC staff is preparing an Environmental Assessment (EA). An EA is defined by the Council on Environmental Quality in 40 CFR 1508.9 as a concise public document that briefly provides sufficient evidence and analysis for determining whether to prepare an environmental impact statement or a finding of no significant impact. As part of our environmental review, the NRC staff has also considered the potential impact of the proposed action on endangered species, in accordance with the Endangered Species Act.

On October 17, 2003, I discussed the proposed renewal. This letter formally transmits our request for an official species list. Please provide us with your current official species list for the proposed project area at your earliest opportunity, so that we may complete our EA. After
