Dear Mr. Attorney General:

This letter acknowledges receipt of the second supplement, dated October 16, 2003, to your petition dated April 23, 2003. On July 3, 2003, Mr. Samuel Collins, the former Director of the Nuclear Regulatory Commissions (NRCs) Office of Nuclear Reactor Regulation notified you that your petition, along with the June 3, 2003, supplement, had been referred to him pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.206. He also summarized the actions you requested, the bases for your requested actions, and the actions taken by the NRC that, in effect, partially granted your requests for immediate action.

The NRCs Petition Review Board (PRB) met on October 22, 2003, to discuss the most recent supplement to your petition. The PRB noted that you did not request any additional immediate actions and determined that the supplement will be consolidated with the existing petition and treated pursuant to 10 CFR 2.206 of the Commissions regulations.

Your petition is being reviewed by members of the NRC staff. In accordance with Management Directive 8.11, Review Process for 10 CFR 2.206 Petitions, we will revise our review schedule to accommodate consideration of the additional information included in this petition supplement.

As provided by Section 2.206, we will take action on your request within a reasonable time. I have assigned Mr. Harold Chernoff to be the petition manager for your petition. On November 5, 2003, Mr. Chernoff spoke with Mr. Robert Snook of your staff to offer an opportunity for a meeting or teleconference to discuss the PRBs determination with respect to the October 16, 2003, supplement to your original petition. Mr. Snook indicated that neither a meeting nor a teleconference was necessary. Mr. Chernoff can be reached at 301-415-4018 (e-mail: hkc@nrc.gov).
