) EA 99-234 JOINT STIPULATION BETWEEN TENNESSEE VALLEY AUTHORITY AND NRC STAFF Pursuant to the Atomic Safety and Licensing Board's (Board) Fifth TelephonePrehearing Conference on April 9, 2002, the Nuclear Regulatory Commission (NRC)Staff and the KUJ Tennessee Valley Authority (TVA) hereby file this joint stipulation regarding the TVA Office of the Inspector General investigation report of Ronald Grover, dated January 25, 2001. For purposes of this proceeding only, the parties hereby stipulate that:

1. The TVA OIG investigated allegations of misconduct by Ronald Grover and issued its final report on January 25, 2001. The report concluded that Grover had engaged in certain misconduct over the course of his TVA employment.
2. The report concluded that Grover made more than 2,500 unauthorized personal long-distance phone calls from his TVA telephone and more than 3,2000 unauthorized personal calls with a TVA calling card.
3. The report concluded that Grover engaged in a pattern of leave abuse in connection with Grover's outside business activities and that Grover was not in leave status on more than 100 days while traveling out-of-state in connection with his personal business or other non-TVA matters. The report also concluded that Grover conducted personal business during

TVA time. In addition, the report found evidence that Grover submitted falsified leave slips in 2000 after being questioned by the OIG about the use of leave during 1998.

4. The report stated that Grover never submitted a request to TVA management to engage in outside work activities, failed to fully disclose outside income, work activities, liabilities, transactions, and partnership interests on his federal financial disclosure forms.
