RE: CLARIFICATION OF APPLICABILITY OF RELIEF REQUEST A-9 FOR INSERVICE INSPECTION (ISI) OF CPSES, UNIT 2 (TAC NO. MB7946)

Dear Mr. Terry:

I am responding to your letter dated September 11, 2003, requesting clarification that Relief A-9 for the second ten-year ISI interval is applicable to the first ten-year ISI interval.

By application dated March 6, 2003, as supplemented by letter dated July 1, 2003, TXU Energy (the licensee) submitted Relief Request A-9 for CPSES, Unit 2, pursuant to 10 CFR 50.55a(a)(g) (4)(iv), from the requirements of American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (Code), 1986 Edition with no Addenda, Table IWB-2500-1. The relief was requested for the second ten-year ISI interval.

By letter dated September 3, 2003, the U.S. Nuclear Regulatory Commission (NRC) authorized Relief A-9 for the second ten-year ISI, as requested by the licensee.

In the September 11, 2003, letter, the licensee requested revision of the applicability of Relief A-9 to the first ten-year ISI interval. The licensee explained that, in its July 1, 2003, supplemental letter, it had inappropriately requested the applicability of Relief A-9 to the second ten-year ISI interval instead of the first interval, and the interval change was not brought to the NRC staffs attention.

The staff has reviewed the licensees request to revise the applicability of Relief A-9 to the first ten-year ISI interval, and finds that the staffs September 3, 2003, approval of Relief Request A-9 is applicable to the first ten-year ISI interval. Accordingly, Relief A-9 for the first

C. Lance Terry ten-year ISI interval is authorized for CPSES, Unit 2. All other requirements of the ASME Code, Sections III and XI, for which relief has not been specifically requested, remain applicable, including third party review by Authorized Nuclear Inservice Inspector.
