Dear Mr. Dusaniwskyj:
Pursuant to your telephone conversation with Mr. Thomas W. Yurik of Rochester Gas and Electric Corporation (RG&E) on September 2, 2003, RG&E provides the following supplemental information concerning the decommissioning funding status report for the R. E.
Ginna Nuclear Power Plant, submitted by RG&E on March 31, 2003. That report indicated that the assumed rates of earnings after taxes on the qualified and non-qualified decommissioning funds are 6.40% and 4.77% respectively. These earnings rates were approved by the State of New York Public Service Commission (NYPSC) in its "Order Adopting Terms of Settlement Subject to Conditions and Changes," issued November 26, 1997, in the proceeding entitled In the Matter of Rochester Gas and Electric Corporation 's Plans for Electric Rate/Restructuring Pursuant to Opinion No. 96-12, Case 96-E-0898. The NYPSC's Order approved, subject to conditions and modifications not pertinent here, the Amended and Restated Settlement Agreement entered into by RG&E, the Department of Public Service staff, and customers to address electric restructuring issues in the New York market, including recovery in rates of RG&E's nuclear decommissioning costs. The terms of the Settlement included the rates of earnings on the decommissioning funds shown in RG&E's decommissioning funding status report, and such terms were approved by the NYPSC's Order referenced above.
