CLOSURE OF NOTICE OF ENFORCEMENT DISCRETION (NOED)
REGARDING OPERATOR LICENSE CONDITIONS (NOED-02-3-009)
Dear Mr. Cisco:
This refers to the July 3, 2002, request from Exelon Generating Company (Exelon) for a Notice of Enforcement Discretion (NOED). The request was based on information from the Exelon staff that confirmed that the comprehensive written examination, required by 10 CFR 55.59(a) for your license, was not administered within the required time period. This resulted in a violation of the terms and conditions of your NRC license. Exelon staff subsequently provided information to the NRC indicating that you had successfully completed a comprehensive requalification written examination prior to July 3, 2002. By a letter dated July 17, 2002, we informed you that the requested NOED was not necessary.
Based on the results of the August 26-30, 2002, inspection at the Dresden Nuclear Power Station, we determined that a scheduling error by training department personnel caused the NRC required comprehensive written examination not to be scheduled within the required 24 months. After considering the information developed during the inspection, the NRC has decided not to take enforcement action against you in this matter.
Although scheduling and implementing the requalification program is Exelons responsibility, it is your responsibility to ensure that you are meeting all conditions of your license. This includes successfully completing all portions of the biennial requalification program (including the annual operating examination and biennial comprehensive written examination). The NRC expects that an individual licensed by the NRC is always aware of the conditions and restrictions of their license and knows the current status of those conditions and restrictions at all times.
You are not required to respond to this letter. However, should you choose to respond, your response should be sent to the U.S. Nuclear Regulatory Commission, ATTN: Regional Administrator, Region III, 801 Warrenville Road, Lisle, Illinois 60532-4351, and marked Open by Addressee Only.
