FJon Hopkins - question from RIC to be posted on NRC web page.mlm Page 1 0: UCS's review of Davis Besse Indicated that the Boric Acid Corrosion Generic Letter had not been Incorporated into the design basis. First - [Did FENOC sign] the [10 CFR 50.54] (f) letter that the design basis would be maintained? [Secondly], Why has NRC failed to take enforcement action [citing 10 CFR 50.54(f)]?

Answer:

The Boric Acid Corrosion Generic Letter (GL 88-05) is part of the Davis-Besse design basis.

This is made clear in the NRC Augmented Inspection Team inspection report dated May 3, 2002 (ADAMS accession no. ML021260141), which contains the following statement.

uDavis-Besse's implementing procedure for GL 88-05 was NG-EN-00324, Boric Acid Corrosion Control."

The Davis-Besse licensee responded to our letter dated October 9, 1996, concerning adequacy and availability of design bases information by letters dated February 11 and March 31, 1997, and December 17, 1999. The licensee in a meeting with the NRC on May 7, 2003, stated on a presentation slide that they intend to submit a supplemental letter on design basis information to the NRC that captures the results of their current system design reviews. The NRC will review the supplemental letter when it is received.
