U. S. Nuclear Regulatory Commission AEP:NRC:3054-11 Page 2 This letter withdraws a request for relaxation of reactor vessel head penetration inspection requirements for Donald C. Cook Nuclear Plant (CNP) Unit 1, and withdraws an associated commitment.

NRC Order EA-03-009 (Reference

1) established interim inspection requirements for reactor pressure vessel head penetrations at pressurized water reactors. In Reference 2, I&M requested relaxations from certain inspection requirements in that order for CNP Unit 1 and Unit 2. Reference 3 provided a revised response to an NRC request for additional information (RAI) regarding the requested relaxations. As stated in Reference 3, the information provided in the letter applied only to Unit 2. I&M committed in Reference 3 to submit the requested information for Unit 1 by. separate correspondence. The committed date was that necessary to support the next Unit 1 under-head inspection required by the order.

The next Unit 1 under-head inspection required by the order is currently scheduled for Spring 2005.

Examination techniques and requirements may change prior to that inspection, precluding the need for relaxation. Therefore, I&M withdraws the request for relaxation of inspection requirements for Unit 1, and the associated commitment. If a relaxation of inspection requirements is needed for Unit 1, I&M intends to request the relaxation via separate correspondence, including the necessary supporting information.

This letter contains no new regulatory commitments.
