2) EA-03-038, "Issuance of Order For Compensatory Measures Related To Fitness-For-Duty Enhancements Applicable To Nuclear Facility Security Force Personnel."

Dear Sir or Madam:

On April 29, 2003, the NRC issued an Order requiring additional compensatory measures related to Fitness-For-Duty for security force personnel (ref: 2).

This letter supplements Energy Northwest's June 3, 2003 response to the Fitness-For-Duty Order (EA-03-038) (the Order), made pursuant to the requirements of 10 CFR § 50.4. As discussed below, Energy Northwest fully intends to comply with the Order.

Page 2 of 3 Letter from Director, Nuclear Reactor Regulation dated July 10, 2003 (ref: 1) stated:

You are required to respond to items B. 1, B.2, and C.1 of Section III in the Order and submit the required information to the NRC in accordance with 10 CFR 50.4 within fifteen (15) days of the date of this letter.

Energy Northwest's Response to Order EA-03-038 items B.1, B.2, and C.1 of Section III At this time, Energy Northwest knows of no matters about which the Commission must be notified pursuant to Section h.B.1 or B.2 of the Order, but will promptly notify the Commission if any such matters arise in the course of Energy Northwest's further implementation of the Order. In response to Section III. C. 1, Energy Northwest immediately began implementation of the requirements in Attachment 2 to Order EA-03-038 and will be in compliance by October 29, 2003.

Pursuant to the requirements of 10 CFR § 2.202(a)(2), an Answer is being transmitted to the Secretary of the Commission under separate cover. In addition, a letter to the Director, Office of Nuclear Reactor Regulation requesting relief related to two items is also separately being submitted. Those two items are: (1) an interpretation contained in the July 10, 2003 letter involving the accounting of turnover time in the work-group provisions of the Order; and (2) a relaxation of the group work-hour controls during the preparation for and the conduct of force-on-force exercises.
