CLOSURE OF CONFIRMATORY ACTION LETTER NO. 1-01-005
Dear Mr. Maret:
This refers to your letter dated October 23, 2001, our Confirmatory Action Letter (CAL) No.
1-01-005, dated October 26, 2001, and your letters dated June 12, 2002 and August 8, 2002, in response to our May 23, 2002 letter regarding issuance of the NRC Order for Interim Safeguards and Security Compensatory Measures for the Yankee Rowe Plant (Decommissioning Order). This also refers to your letter dated November 5, 2002, in response to our October 16, 2002, letter, regarding issuance of the NRC Order for Interim Safeguards and Security Compensatory Measures for Independent Spent Fuel Storage Installations (ISFSI Order). Your Yankee Rowe plant no longer has spent fuel in wet storage and all licensed spent fuel is stored in an onsite ISFSI. Therefore, the requirements of the Decommissioning Order have been superceded by the ISFSI Order. Based on our review of your response letters, the NRC has determined that all of the commitments listed in the CAL are met or have been superceded by actions you have taken in regard to compliance with the ISFSI Order. Based on this determination, we are closing CAL No.
1-01-005, and no further response is required regarding the CAL.
