This is to inform the Commission that the S.C. Department of Health and Environmental Control considerptis matter closed. However, if some new developrnplntocurs regarding the incident, we would appreciate a rompt notificatio.

Chewning, Jr., DMD In reference to your letter-of June-2, 2003, and your report BEDL 016, Environmental Assessment of Millstone Fuel Rods, please be advised that the Department concurs with the conclusions of the assessment regarding the potential for an extremely low exposure (less than 1.5 X 10 ' mrem annually TEDE), if in fact the fuel pins were disposed in Slit Trench No. 8; and the continued sampling down gradient for any radionuclides that would be attributable to this waste form.

In addition, a special notation regarding this incident should be made in the Slit Trench No. 8 History file for future reference.

With the exception of the actions mentioned above, the Department considers this incident closed. We appreciate you cooperation in resolving this matter, and the efforts provided by the Chem-Nuclear staff and management.
