COMANCHE PEAK STEAM ELECTRIC STATION, UNITS 1 AND 2 RE:

RESOLUTION OF FINDINGS AND FOLLOWUP ACTIONS ASSOCIATED WITH THE MARCH 25, 2003, INSPECTION - CATEGORY I SAFE SHUTDOWN IMPOUNDMENT DAM (TAC NOS. MB7877 AND MB7878)

Dear Mr. Terry:

The U.S. Nuclear Regulatory Commission (NRC) staff herein forwards the results of the March 25, 2003, inspection of the Comanche Peak Steam Electric Station (CPSES) Category I Safe Shutdown Impoundment Dam (SSID). The inspection was conducted by the NRC staff and our consultant, the U.S. Federal Energy Regulatory Commission (FERC), Office of Dam Safety and Inspection. Since the FERC report contains specific information on the dam, including location, and dimensions, it will not be publically available in accordance with NRC policy. The enclosed report concludes that no conditions were found during this inspection that should adversely affect the immediate safety, permanence, and operational reliability of the SSID or present a threat to the safety of the public or the nuclear facility. Section F. of the enclosed report contains two Specific Findings and Necessary Follow-up Actions items, representing actions that should be taken by TXU Energy, to insure the continued safety of the SSID for the Category I safe shutdown pond, consistent with the Federal Guidelines for Dam Safety (1979) and the Dam Safety Program Act defined in the Water Resources Act of 1996.

These two items are as follows:

Since the SSID outer shell surface rock is slowly deteriorating, it was agreed that the licensees annual inspection should closely monitor the condition. The licensee also agreed to consider addressing the replacement of the rock shell prior to expiration of the CPSES, Unit 1, Facility Operating License to coincide with the submittal of an application for license extension.

The monitoring of the piezometers should be continued annually.
