REVIEW OF THE PHYSICAL SECURITY PROGRAM FOR DIABLO CANYON POWER PLANT (DCPP) AND THE ASSOCIATED INDEPENDENT SPENT FUEL STORAGE FACILITY (ISFSI)

By letter dated December 21, 2001, Pacific Gas & Electric Company (PG&E) submitted a license amendment request, under their 10 CFR Part 50 licenses to request changes in the DCPP Physical Security Plan to reflect the presence of the proposed ISFSI. By letter dated April 18, 2002, PG&E withdrew their application for license amendment, but requested that the NRC staff review the proposed changes in the DCPP Physical Security Plan prior to implementation. Finally, in a letter dated January 31, 2003, PG&E stated that the proposed changes do not decrease the effectiveness of plant security; the implication being that no NRC staff review of the proposed changes in the DCPP Physical Security Plan is required prior to implementation.

On May 16, 2003, staff members from the Offices of Nuclear Reactor Regulation, Nuclear Material Safety and Safeguards, and Nuclear Security and Incident Response met to determine the course of action to be taken with regard to changes in the DCPP Physical Security Plan needed to reflect the presence of the proposed ISFSI. The meeting attendees concluded that the NRC staff review of the proposed changes in the DCPP Physical Security Plan would be documented as part of the ISFSI licensing process under 10 CFR Part 72. In addition, because the proposed changes do not decrease the effectiveness of plant security, no further NRC action is needed under the DCPP 10 CFR Part 50 licenses. Accordingly, TAC Nos. MB5000 and MB5001 are closed.
