Merschoff (Nuclear Regulatory Commission), dated January 30, 2003, "Confirmatory Action Letter."

The purpose of this letter is to document revisions to the Confirmatory Action Letter (CAL) in Reference 1. In a phone conversation held March 5, 2003 between Kriss Kennedy, Chief, Branch F, Nuclear Regulatory Commission and Paul Fleming, Manager, Licensing and Regulatory Affairs, Nebraska Public Power District, the details of the revision were discussed. The revision was planned before publication of the CAL on January 30, 2003, but the CAL was issued before this revision could be incorporated into that document.

The revision concerns Action Plan 5.2.1.2, "Operability Determinations." The CAL currently includes Steps 1-9 of this Action Plan. The revised CAL should include Steps 1-10 of that Plan.

Since completion of Step 7 is scheduled for the third quarter of 2004, only the start and continued progress of activities in that step should be addressed as part of the CAL.

In the revision, Step 7 has been expanded to include a longer term monitoring function for the interim operability determination oversight group. Step 10 was added to the CAL to assure improvement in operability determination consistency and quality by those charged with performing the activity.

COMMITTED DATE COMMITMENT OR OUTAGE Short-term improvements addressing the quality of Operability Determinations - Action Plan 5.2.1.2, improve the 1Q04 operations and shift review of OD's, provide a core group of engineering and operations personnel to perform and review OD's and improve the use of CAP data, Action Steps 1-10.

The start and continued progress of activities in Step 7 of 1Q04 Action Plan 5.2.1.2 will be implemented as scheduled.
