Access to Safeguards Information must be limited to personnel with a "Need to Know" basis and who have been fingerprinted and had an FBI criminal records check performed or has one in progress.
Documents and materials which contain Safeguards Information must be appropriately marked.
Safeguards Information must not be left unattended and must be stored only in files or containers meeting GSA requirements.
Safeguards Information must not be discussed over the telephone or entered into computerized data base networks not protected by security access controls.
The federal regulations apply to persons as well as corporations.
The Atomic Energy Act of 1954, as amended, provides that any person who violates NRC Regulations concerning SI, regardless of whether or not the violation was intentional, is subject to a civil penalty of up to $100,000 per violation. Ifthe violation was intentional, NRC may refer the matter to the Justice Department for prosecution.
Conviction could result in a fine of up to $25,000 per day of violation, or two years imprisonment, or both.
