Dear Mr. Conte:

I am writing concerning your letter of January 24, 2003, to Mr. Mark E. Warner, Site Vice Pres4ent, Seabrook Station. Your letter enclosed copies of Region One's Deficiency letters to the State oWew Hampshire and the Commonwealth of Massachusetts.

While it is true that the letters officially informed New Hampshire and Massachusetts of Deficiencies identified at the October, 2002, Seabrook Nuclear Power Station Exercise, those Deficiencies were reconsidered when the NRC advised FEMA they did not believe these issues rose to the level of a Deficiency.

FEMA, Region One had extensive discussions with both New Hampshire and Massachusetts and with Craig Conklin, Division Director of FEMA's Office of National Preparedness, Technical Services Branch. Following these discussions, and based on NRC recommendations, Daniel McElhinney, Region One Regional Assistance Committee (RAC) Chair re-classified these issues as Areas Requiring Corrective Action (ARCA).

A copy of the Final Exercise Report for the Seabrook Exercise was sent to the NRC electronically on January 30, 2003. A CD copy and hard copy will be forwarded shortly. Region One would request that a letter be sent to all persons on the original distribution list advising them of the correct status of these issues as soon as possible.
