Dear Mr. Shadis:
By letter dated February 17, 2003, you filed a petition on behalf of the New England Coalition on Nuclear Pollution that was addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission (NRC), asking for consideration pursuant to 10 CFR 2.206 of the Commissions regulations. Your petition was referred to the Office of Nuclear Reactor Regulation. In your letter, you request that the NRC take appropriate enforcement action against both an employee of the licensee and the licensee for Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and 3) regarding the possible mishandling of safeguards information.
Our petition review board has reviewed your submittal. The staff has concluded that your submittal will not be considered under 10 CFR 2.206 because the issues that you raise are more appropriately addressed within our Allegations Management Program. In accordance with the allegations process, you will be kept apprized of the NRCs actions in this matter.
