SUMMARY

- MEETING WITH DUKE ENERGY AND FLORIDA POWER AND LIGHT ON SPENT FUEL POOL BORAFLEX UPDATE FOR MCGUIRE AND TURKEY POINT Representatives of Duke Energy Corporation (Duke) and Florida Power and Light (FPL), met with members of the U.S. Nuclear Regulatory Commission (NRC) staff at NRC Headquarters on December 10, 2002, in Rockville, Maryland. The meeting addressed issues related to the degradation of Boraflex panels in spent fuel pool (SFP) storage racks. An earlier meeting on this subject was held on December 11, 2001. A list of attendees is provided in Attachment 1 and the handouts provided in the meeting are included in Attachment 2.

Duke outlined its ongoing initiatives at McGuire, including accelerated options for dry spent fuel storage, reracking one of the regions of the McGuire SFP and its ongoing license amendment application for revised soluble boron credit. That license amendment application was approved on February 4, 2003, with the issuance of Amendments 210 and 191 to the McGuire, Unit 1 and 2 Operating Licenses, respectively.

Page 4 of the Duke-FPL presentation materials provides a summary of the current situation.

The McGuire SFP is divided into two regions. Region 1, with 286 storage spaces, is planned to be reracked with racks of similar design except that the neutron absorber will be boral. Duke is considering the use of RackSaver inserts for insertion into Region 2, containing 1177 storage spaces. Duke indicated that it plans to submit a license amendment application on the use of the RackSaver inserts about July 2003, with a target date for an NRC decision on the application of July 2004. FPL indicated similar plans for Turkey Point with dates of October 2003 and October 2004. Two types of RackSaver materials were discussed, borated stainless steel and Metamic, a borated aluminum material.

Plans were discussed for a further meeting to continue the dialogue between the licensees and the NRC staff on this subject. The NRC staff indicated that the presentations provided much useful information.
