SUMMARY

OF LICENSE RENEWAL MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) STAFF AND THE NEI LICENSE RENEWAL WORKING GROUP; DUKE FOR THE MCGUIRE AND CATAWBA NUCLEAR STATIONS, UNITS 1 AND 2; EXELON FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3; FPL FOR ST. LUCIE, UNITS 1 AND 2; OPPD FOR THE FORT CALHOUN STATION; CP&L FOR THE H.B. ROBINSON STEAM ELECTRIC PLANT, UNIT 2; RG&E FOR THE R.E. GINNA NUCLEAR POWER PLANT; AND SCE&G FOR THE VIRGIL C. SUMMER NUCLEAR STATION A joint meeting was held on February 12, 2003, to discuss the status of license renewal activities. The meeting began with discussions between the NRCs License Renewal Steering Committee (LRSC) and NEIs License Renewal Working Group on the general status of license renewal applications and generic license renewal activities. The meeting continued with discussions between NRC management and Duke (McGuire and Catawba), Exelon (Peach Bottom), FPL (St. Lucie), OPPD (Fort Calhoun), CP&L (Robinson), RG&E (Ginna), and SCE&G (Summer) regarding the progress of the license renewal application reviews. Attendees at the meeting are listed in Enclosure 1. The meeting agenda and the NRC staffs presentation materials are contained in Enclosure 2. A summary of the discussions held at the meeting follows.

I.

Meeting between the NRC License Renewal Steering Committee and NEI License Renewal Working Group A. Status of applications Duke, Exelon, FPL, OPPD, CP&L, RG&E, and SCE&G provided brief summaries of their license renewal application reviews which were subsequently discussed in more detail during the management portion of the meeting (see summaries below). A license renewal application for Dresden, Units 2 and 3, and Quad Cities, Units 1 and 2, was received by the NRC on January 3, 2003.

B. License renewal interest Page 1 of Enclosure 2 shows the latest information the NRC has regarding licensee plans for submitting license renewal applications. No changes to the submittal plans shown were identified at the meeting. NEI noted that by fall of 2003, approximately one-third of the U.S.

plants will have either received renewed licenses or be under review by the NRC for renewal.

NEI indicated that it continues to emphasize to licensees the importance of notifying the NRC as early as possible of their renewal plans, but it cannot control the number or timing of renewal applications submitted to the NRC.

To emphasize to licensees the importance of notifying the NRC of their plans for submitting renewal applications, the NRC staff issued on February 3, 2003, Regulatory Issue Summary (RIS) 2003-02, Importance of Giving NRC Advance Notice of Intent to Pursue License Renewal, (ML030340042). This RIS is similar to RIS 2000-20 issued on November 14, 2000, with the same title (ML003752145) and was needed because the NRC does not have information beyond the next two years regarding planned renewal submittals. One change between RIS 2003-02 and RIS 2000-20 is that a licensees submittal plans must now be in writing to be included in the NRCs planning and budgeting process. This change was required due to the uncertainty associated with oral notifications and the substantial resources that must be allocated for each application.

C. Lessons learned and license renewal guidance development (1) Generic renewal application format NEI established a Standard License Renewal Application Task Force which met with the NRC staff to develop a preferred format for future renewal applications. This format is intended to better define the method of incorporating the Generic Aging Lessons Learned (GALL) Report (NUREG-1801) into renewal applications to obtain the intended efficiencies. By letter dated January 24, 2003 (ML030290201), NEI submitted the industrys proposed standard license renewal application format for staff review. The staff is currently reviewing the proposed format and will respond to NEI. NEI indicated that the proposed format is being used by future applicants, including the two remaining applications scheduled for submittal in 2003.

(2) Interim staff guidance (ISG) status An ISG process was developed to incorporate lessons learned from the demonstration project and the ongoing license renewal application reviews. ISGs are intended to provide guidance in the interim until the applicable guidance documents (regulatory guide, standard review plan, or GALL report) are revised. Currently, there are 14 ISGs, of which 4 have been completed. The NRC staff and NEI agreed that only technical issues will be retained as ISGs, resulting in deletion of 2 ISGs that are process in nature. The NRC staff plans to update the guidance documents in 2004, incorporating the ISGs completed at that time. The Committee to Review Generic Requirements will evaluate the ISGs as part of its review of the updated guidance documents. NEI indicated that it plans to update its guidance document, NEI 95-10 (endorsed by the NRCs license renewal regulatory guide), after the standard license renewal application format is established.

(3) Fire protection scoping ISG By letter dated November 13, 2002 (ML023190474), the staff issued a proposed ISG to address scoping reviews for fire protection equipment. Specifically, the ISG states that fire protection equipment that meets the scoping criteria for license renewal is the equipment that an applicant relies upon and credits, as part of a plants current licensing basis (CLB), to meet the requirements of 10 CFR 50.48, the fire protection rule. The ISG also states that the CLB for meeting the fire protection rule can vary from plant to plant and, as a result, fire protection reviews for license renewal must be conducted on a plant-specific basis. The ISG lists a number of documents that describe a plants CLB for meeting the requirements of the fire protection rule.

During the meeting, NEI expressed concern that the ISG attempts to redefine the CLB for license renewal applicants. Utility representatives explained that the fire protection scoping reviews are typically conducted using a list of specific equipment (an F-list) that has been specifically designated as belonging to a special category for fire protection. The staff expressed its view that previous, and some current, applicants for license renewal had not reviewed all the relevant documents that define a plants CLB to ensure that all fire protection equipment relied upon to meet regulatory requirements had been identified. Although the staff agreed with the utility representatives that the F-lists specify equipment that meets license renewal scoping criterion 54.4(a)(3), the staff has found that these F-lists do not always provide an accounting of all equipment relied upon to meet regulatory requirements for fire protection.

(4) Additional topics discussed The Commission recently reduced the schedule for completing the review of uncontested renewal applications from 25 to 22 months from the date of receipt. The decrease to 22 months will require reductions in the application review schedules. The staff will work with the applicants in developing the revised review schedules.

NEI commented that each applicant prepares their renewal application by building on what was accepted for the previous application. However, NEI stated that the number of requests for additional information does not seem to be decreasing. Efficiencies have been seen by the licensees in the preparation of recent applications now that the reviews have been completed for similar plant designs and through their use of the same staff to prepare follow on applications. The first applications that used the Generic Aging Lessons Learned Report and the license renewal standard review plan are still under review and the degree of efficiency from the use of these documents is yet to be determined. The staff agreed to review the resource expenditures for past applications and provide an assessment at the next meeting of whether efficiencies are being achieved.

D. Public Participation No member of the public chose to participate in this portion of the meeting.

The next meeting between the LRSC and the NEI License Renewal Working Group will be scheduled in approximately three months.

II. Meetings between NRC Management and License Renewal Applicants A. Status of applications (1) McGuire, Units 1 and 2, and Catawba, Units 1 and 2 Duke commended the staff on its February 6, 2003, presentation to the Advisory Committee on Reactor Safeguards (ACRS). The applicant and the staff both acknowledged that the ACRS presentations were successful. Duke discussed recent accomplishments in the safety and environmental reviews, indicating that the staffs safety evaluation report (SER) and supplemental environmental impact statements (SEISs) for McGuire and Catawba had been issued.

Duke also provided the status of the hearing process, indicating that the Commission had responded to its request for clarification of its ruling on the admissibility of the severe accident mitigation alternative (SAMA) contention pertaining to Dukes failure to consider information from a direct containment heating study performed by Sandia National Laboratory and documented in NUREG/CR-6427. In its clarification, the Commission had characterized that contention as moot in light of subsequent consideration by the staff and the applicant of the information in the Sandia report. The staffs evaluation of the information, and associated conclusions, is documented in the McGuire and Catawba SEISs. Duke further noted that the Atomic Safety and Licensing Board had granted Dukes request that the SAMA contention be dismissed in light of the Commissions clarification. Duke also indicated that the Commission had reinstated late-filed contentions related to the SAMA contention, which would be the subject of oral arguments on February 18, 2003. (These oral arguments were subsequently postponed to March 18, 2003, due to weather conditions and the closing of the Federal Government on February 18, 2003.)

The review accomplishments to date as well as future activities are outlined on pages 2 and 3 of Enclosure 2. Dukes presentation materials are contained in Enclosure 3.

(2) Peach Bottom, Units 2 & 3 Exelon provided an update on the progress of the Peach Bottom license renewal application review (Enclosure 4). The staffs presentation materials are contained on pages 4 and 5 of. The applicant stated that the staff issued the Peach Bottom SEIS ahead of schedule on January 22, 2003, and the SER on schedule on February 6, 2003. The applicant added that it had spoken with representatives from NRC Region I and it expected the Regional Administrators letter to be issued on schedule. The applicant noted several of the upcoming activities, such as the March 6, 2003, ACRS full committee meeting as listed in Enclosure 4.

The applicant summarized that communications with the staff have been good.

(3) St. Lucie, Units 1 and 2 FPL provided an update of the progress of the St. Lucie, Units 1 and 2, license renewal application review (Enclosure 5). The staffs presentation material is contained on page 6 of. The NRC staff has completed its aging management review (AMR) inspection and has issued the SER with open items. The comment period for the draft SEIS has ended.

The applicant summarized its assessment of the open items in the SER and stated that it does not agree that items already addressed in the license renewal application should be identified as open or confirmatory items. In summary, the applicant noted that license renewal activities are on schedule and communications between FPL and the NRC are frequent. The staff noted that FPL was the first applicant to credit some of its aging management programs as being consistent with the GALL Report. The staff explained that because the AMR inspection team is responsible for verifying this claim, the staff cannot complete its assessments of these aging management programs, which credit consistency with the GALL Report, until the AMR inspection report is issued.

(4) Fort Calhoun OPPD provided an update of the progress of the Fort Calhoun license renewal application review (Enclosure 6). The staffs presentation material is contained on page 7 of Enclosure 2.

The staff and OPPD noted the accomplishments over the last several months for the review of the LRA for Fort Calhoun. The staff and OPPD have met or exceeded all scheduled milestones to date.

OPPD and the staff noted that the scoping inspection was completed in November 2002 and the AMR inspection was completed in January 2003. In addition, several open items identified during the scoping inspection were resolved during the AMR inspection. OPPD provided responses to the staffs RAIs in mid-December 2002. OPPD also received a partial fee reduction to reflect revisions to the renewal application. Finally, the notice of availability of the draft SEIS was issued in early January 2003 (the public comment period ends on April 10, 2003). Communications between OPPD and the staff continue to be good and the process, to date, has been efficient, effective, and productive.

Future activities included conducting the public meeting on the draft SEIS (subsequently held on February 26, 2003) and issuance of the SER with open items by April 21, 2003. The Fort Calhoun application is the first to be submitted that was prepared in accordance with, and will be reviewed using the license renewal standard review plan and GALL report.

(5) H.B. Robinson, Unit 2 CP&L provided an update of the progress of the H.B. Robinson license renewal application review (Enclosure 7). The staffs presentation material is contained on page 8 of Enclosure 2.

The staff and CP&L noted the accomplishments over the past several months for the review of the application. The staff and CP&L have met or exceeded all schedule milestones to date.

The staff also prepared initial drafts of requests for additional information (RAIs) and provided them to CP&L for review and discussion. Final RAIs were sent on February 11, 2003, meeting the milestone. Communications between CP&L and the staff were characterized as good and the process, to date, has been efficient, effective, and productive. Future activities include responding to the RAIs, and conducting the scoping inspection in April 2003 and AMR inspection in June 2003.

(6) R.E. Ginna RG&E provided an update of the progress for the Ginna license renewal application review.

The NRC staffs presentation materials are contained on pages 9 and 10 of Enclosure 2. The staff and RG&E noted the accomplishments over the past several months for the review of the application. The staff and RG&E have met or exceeded all scheduled milestones to date.

Upcoming milestones for March 2003 include receipt of the applicants responses to the environmental RAIs and transmittal of the final safety RAIs to the applicant. Communications between RG&E and the staff were characterized as good and the process, to date, has been efficient, effective, and productive.

(7) Virgil C. Summer SCE&G provided an update of the progress of the Summer license renewal application review.

The NRC staffs presentation material is contained on page 11 of Enclosure 2. The applicant and the staff noted the accomplishments over the past three months for the review of the application. The staff has met all the scheduled milestones to date. Upcoming milestones include receipt of the applicants responses to the environmental RAIs, and the transmittal of the final safety RAIs to the applicant. The applicant also noted that the interface with the NRC staff has been excellent and that the meetings have been productive to both the applicant and the NRC staff.
