Committed to Nuclear Excellence Kewaunee Nuclear Power Plant Operated by Nuclear Management Company, LLC NRC-03-017 10 CFR 2.202 February 27, 2003 Secretary, Office of the Secretary of the Commission U.S. Nuclear Regulatory Commission ATTN: Rulemakings and Adjudications Staff Washington, DC 20555 KEWAUNEE NUCLEAR POWER PLANT DOCKET 50-305 LICENSE No. DPR-43 RESPONSE TO ORDER EA-03-009, "ISSUANCE OF ORDER ESTABLISHING INTERIM INSPECTION REQUIREMENTS FOR REACTOR PRESSURE VESSEL HEADS AT PRESSURIZED WATER REACTORS" By letter dated February 11, 2003, the Nuclear Regulatory Commission (NRC) issued Order EA 03-009, "Issuance of Order Establishing Interim Inspection Requirements for Reactor Pressure Vessel Heads at Pressurized Water Reactors." Nuclear Management Company, LLC (NMC) hereby consents to the order EA-03-009 as written.
By letter dated August 26, 2002, NMC provided the Kewaunee Plant response to Bulletin 2002 02, "Reactor Pressure Vessel Head and Vessel Head Penetration Nozzle Inspection Programs."
In that letter, NMC made two commitments: 1) "NMC will continue to evaluate non-visual nondestructive examination (NDE) of the reactor pressure vessel head and vessel head penetration nozzles. NMC will complete this review and select appropriate NDE method(s) and at least nine months prior to the refueling outage that follows the next refueling outage, provide the remaining request information as described in BL 2002-02." and 2) "NMC will perform a 100% Bare Metal Visual Examination of CRDM to RPV Junction at Top of RPV Head during the next refueling outage, currently scheduled for Spring 2003". As a result of the obligations contained in Order EA-03-009, these commitments are hereby rescinded.

- 2. This letter contains no new commitments.
