Dear Mr. Marion:
I am responding to your August 13, 2002, letter that formally submitted the Electric Power Research Institutes (EPRI) Report TR-1003138, PWR Steam Generator Examination Guidelines: Revision 6" (draft), dated May 8, 2002, and EPRI Report R-5515-00-2, Experience of U.S. and International Steam Generators with Alloy 600TT and Alloy 690TT Tubes and Sleeves (draft), dated June 2002, to the Nuclear Regulatory Commission (NRC) for the purpose of supporting NRCs generic regulatory improvements. For the reasons stated below, an exemption from the 10 CFR 170 fees is granted.
The Office of Nuclear Reactor Regulation (NRR) has confirmed that the information submitted with your August 13, 2002, letter will be used to support NRCs generic regulatory improvements, specifically the assessment of the Steam Generator Generic License Change Package. In addition, the NRR staff does not intend to perform a formal review of the reports and will not issue a Safety Evaluation Report (SER), but instead will use these reports as references to gain insight into future license reviews.
Based on the foregoing, I have determined that the reports meet the criteria in 10 CFR 170.11(a)(1)(iii) for an exemption from the 10 CFR 170 fees because the reports were being submitted to the NRC for the specific purpose of supporting NRCs generic regulatory improvements and the NRC plans to use the reports for that purpose.
