Dear Mr. Katz:

The Region I Field Office of NRC Office of Investigations (OI), initiated an investigation (OI Case #1-2000-037) on October 10, 2000, to determine whether a licensed operator exam writer employed by Baltimore Gas and Electric (now Constellation Nuclear) at the Calvert Cliffs Nuclear Power Plant was discriminated against and had his/her employment subsequently terminated by CCNPP management for raising concerns about exam security and for previously filing a complaint with the U. S. Department of Labor (DOL).

Based on the information developed during the investigation, OI determined that the licensed operator exam writers claim of discrimination was not substantiated. A copy of the Synopsis of OI Case #1-2000-037 is enclosed for your information.

Please note that final NRC documents, such as the OI report discussed above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records (copy enclosed).

Also, in accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its enclosure, and your response, if any, will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS). 1 SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), Region I (RI), on October 10, 2000, to determine if an exam writer employed by the then Baltimore Gas and Electric (BG&E) at the Calvert Cliffs Nuclear Power Station (CCNPP), Lusby, Maryland, was discriminated against and subsequently terminated by CCNPP management for raising concerns about exam security and for previously filing a complaint with the Department of Labor (DOL).

After a review of the evidence developed during this investigation, it has been determined that the exam writers claim of discrimination is not substantiated.
