On January 7, 2003, the U. S. Nuclear Regulatory Commission issued an Order that modifies the current operating licenses for plants operated by Nuclear Management Company, LLC (NMC) to require compliance with the specified compensatory measures related to access authorization.

The Order requires the following actions:

A. Comply with the requirements of the Order as described in Attachment 2 except to the extent that a more stringent requirement is set forth in the Licensee's security plan. Licensees shall immediately begin implementation of the requirement of Attachment 2 of the Order and shall complete implementation no later than July 7, 2003, with the exception of compensatory measures B.1.1, which shall be implemented no later than April 7, 2003, and C.1.6 and C.1.8, which shall be completed no later than January 7, 2004.

B. 1. Notify the Commission if (1) NMC is unable to comply with any of the requirements described in Attachment 2 of the Order, (2) ifcompliance is unnecessary in Licensee- specific circumstances, or (3) ifimplementation of any of the requirements would cause a Licensee to be in violation of the provisions of any Commission regulation or the facility license.

2. Notify the Commission ifimplementation of any of the requirements described in Attachment 2 to the Order would adversely impact safe operation of the facility, provide the basis for this determination, and provide a proposal for achieving the same objectives specified in the Attachment 2 requirement in question, or a schedule for modifying the facility to address the adverse safety condition. If neither approach is appropriate, NMC must supplement its response to Condition B1 of the Order to identify the condition as a requirement with which it cannot comply.

C. 1. Submit to the Commission a schedule for achieving compliance with each requirement described In Attachment 2.

2. Report to the Commission when the Licensee has achieved full compliance with the requirements as described in Attachment 2.

D. Maintain all measures implemented or actions take in response to this Order until the Commission determines otherwise.

The NMC 20-day response to the Commission is enclosed.

Unescorted Access Authorization Measures

1.1 Response

Full compliance with this requirement will be achieved by April 7, 2003.

Individuals granted unescorted access (UA) to an NMC facility on a temporary unescorted access authorization (UAA) prior to the effective date of this requirement will maintain their UAA status pending completion of the full background investigation.

1.3.c Response: NMC will be in full compliance with this requirement on April 7, 2003. Each contractor/vendor of individuals granted unescorted access to our facilities will be reminded of their obligation to meet Immigration & Naturalization Service (INS) employment eligibility requirements; specifically, that each employer must be in compliance with 1-9 procedures issued by INS.

When processing an individual for unescorted access, NMC will not confirm employment eligibility through INS. This requirement would impose an added burden to NMC, its owners and to contractor and vendors who employ significant numbers of personnel who do not require unescorted access to NMC-operated facilities. NMC will confirm, to the extent possible, the accuracy of a social security number or alien registration number.
