Dear Mr. Bakken:

This letter refers to an investigation conducted by the U.S. Nuclear Regulatory Commission (NRC), Office of Investigations (OI), to determine if a mechanical maintenance technician was blacklisted from employment at the D.C. Cook Nuclear Power Plant as a result of raising discrimination concerns to the NRC in February 1999. Based on the evidence developed during the investigation, we did not substantiate that a mechanical maintenance technician was blacklisted from employment at D.C. Cook. The synopsis from the OI report of investigation is enclosed.

3 SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region III, on August 27, 2001, to determine whether a former contract mechanical maintenance technician (MMT) was discriminated against by being blacklisted from further employment at American Electric Power Companys D.C. Cook Nuclear Power Plant (Cook) as a result of raising discrimination concerns to the NRC in February 1999.

Based upon the evidence developed, this investigation did not substantiate the allegation that the MMT was discriminated against by being blacklisted from employment at Cook.
