Enclosed for your information is the synopsis of the Nuclear Regulatory Commissions (NRC)

Office of Investigations (OI) completed report regarding alleged discrimination, by the Florida Power and Light Company against an employee who reported safety concerns. This employee filed a complaint with the Department of Labor.

OI determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission, Office of Investigations, Region II (RII), on November 1, 2001, to determine if a former non-licensed operator, employed at the Florida Power and Light Company St. Lucie Nuclear Plant (SLNP),

was discriminated against by SLNP management after reporting safety concerns.

Based on the evidence, documentation, and testimony developed during this investigation, and coordination with the RII technical staff and Regional Counsel, the allegation that a former non-licensed operator at SLNP was discriminated against by SLNP management after reporting safety concerns was not substantiated.
