CLOSEOUT OF CONFIRMATORY ACTION LETTER RIII-01-003 BIG ROCK POINT

Dear Mr. Haas:

On December 14, 2001, the U.S. Nuclear Regulatory Commission (NRC) issued a Confirmatory Action Letter (CAL) RIII-01-003 for the Big Rock Point facility. The CAL was issued to document your commitments to implement both short and long term corrective actions which address specific aspects of your physical security protection program.

Based on our telephone call of December 15, 2001, and our inspection activities of these commitments documented in Inspection Report 05000155/2002-003(DNMS), we have determined that you have met all of the commitments as specified in the above CAL. The long term commitments of this CAL have been superceded by the NRCs Order dated May 23, 2002, which specified additional physical security requirements. Your letter of November 15, 2002, documents your compliance with this Order. The NRC will perform an inspection to verify your compliance with the Order. Accordingly, this CAL is considered closed.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
