To Whom It May Concern:
I David J DiProspero am returning a response regarding my notice of violation. I feel it necessary to correct several implications and contest your decision based off your telephone investigation on Sept.12th, 2002.
One: When I was interviewed on Sept.12 t h, 2002 I was asked to help with an investigation on any wrong doing involving RG&E regarding my termination. I was never told I was under investigation or informed that I would be subject to any action, such as a violation.
Two: Yes, it is my assertation that nutrient supplements, specifically "Cell Tech" by Muscle Tech lowered my ph to below 3. This is because there is a ph acidity warning on the back of the bottle. I was also on my loading phase, during this phase "Cell Tech" s daily dosage is doubled and I admitted to doubling that dosage since the product was close to its expiration date.
Third: The supporting evidence that I was not able to provide to RG&Es MRO was not possible. He wanted laboratory tests on myself and the supplements. This not being financially possible and only having about a week to submit this evidence I offered to take another urine test, a hair test, a blood test or any other test. This was not possible according to Sheri Ekert of RG&E because nothing was found in my urine, only an abnormally ph level, and I could not appeal RG&Es decision regarding my termination.
Fourth: You attack my character and imply that I'm some sort of a liar who had" a deliberate disregard for NRC requirements". I left school to pursue a career with the Wackenhut Corp. I never missed a day of work and was promoted directly to a lieutenant within six months of employment. This type of dedication shows only a high regard for NRC requirements.
Finally, after consulting my attorney I not only disagree with your decision but I request that all action against me be dropped due to lack of evidence and failure to inform me that I was actually the one under investigation. In this country we are all innocent until proven guilty, unless you work in the nuclear industry. As far as I know the MRO adulterated my urine specimen. The additional tests that I requested (urine, hair, blood) could have been used to prove no wrong doing on my part but were denied by RG&E. I enjoyed my short lived career however in experiencing the nuclear industry first hand outside of the military I do not intend to reapply at RG&E or any nuclear industry in the future so your confidence should be regained.
