Enclosed for your information is the synopsis of the Nuclear Regulatory Commission (NRC)

Office of Investigations (OI) completed report regarding alleged discrimination against the Florida Power and Light Company by an employee who filed a complaint with the U.S.

Department of Labor.

OI determined that there was insufficient evidence to substantiate the allegation of discrimination. We plan no further action with regard to this matter. Should you have any questions concerning this letter, please contact us.

In accordance with 10 CFR 2.790 of the NRCs "Rules of Practice," a copy of this letter and its enclosure will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS). SYNOPSIS The Office of Investigations (OI), U.S. Nuclear Regulatory Commission (NRC), Region II (RII),

initiated this investigation on August 23, 2001, to determine whether a Florida Power and Light Company, St. Lucie Plant (SLP) protective services manager manipulated the random drug screening process to improperly select an instrumentation and control (I&C) specialist to undergo a random drug screening examination.

Based on the evidence developed, testimony, and an observation of the drug screening process, the allegation that the SLP protective services manager manipulated the random drug screening process to improperly select an I&C specialist to undergo a random drug screening examination was not substantiated.
