SUMMARY
OF LICENSE RENEWAL MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) STAFF AND THE NEI LICENSE RENEWAL WORKING GROUP; VEPCO FOR THE SURRY AND NORTH ANNA POWER STATIONS, UNITS 1 AND 2; DUKE FOR THE MCGUIRE AND CATAWBA NUCLEAR STATIONS, UNITS 1 AND 2; EXELON FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3; FPL FOR THE ST. LUCIE NUCLEAR PLANT, UNITS 1 AND 2; OPPD FOR THE FORT CALHOUN STATION; CP&L FOR THE H.B. ROBINSON STEAM ELECTRIC PLANT, UNIT 2; RG&E FOR THE R.E. GINNA NUCLEAR POWER PLANT; AND SCE&G FOR THE VIRGIL C. SUMMER NUCLEAR STATION A meeting was held on November 4, 2002, to discuss the status of license renewal activities.
The meeting began with discussions between the NRCs License Renewal Steering Committee (LRSC) and NEIs License Renewal Working Group on the general status of license renewal applications and generic license renewal activities. The meeting continued with discussions between NRC management and VEPCO (Surry and North Anna), Duke (McGuire and Catawba), Exelon (Peach Bottom), FPL (St. Lucie), OPPD (Fort Calhoun), CP&L (Robinson),
RG&E (Ginna), and SCE&G (Summer) managers regarding the progress of the license renewal application reviews. The meeting agenda and the NRC staffs presentation materials are contained in Enclosure 1. Attendees at the meeting are listed in Enclosure 2. A summary of the discussions held at the meeting follows.
I.
Meeting between the NRC License Renewal Steering Committee and NEI License Renewal Working Group A. Status of applications VEPCO, Duke, Exelon, FPL, OPPD, CP&L, RG&E, and SCE&G provided summaries of the Surry/North Anna, McGuire/Catawba, Peach Bottom, St. Lucie, Fort Calhoun, Robinson, Ginna, and Summer license renewal application reviews, which were subsequently discussed in more detail during the management portion of the meeting (see summaries below). License renewal applications for Ginna and Summer were received by the NRC on August 1 and October 4, 2002, respectively.
B. License renewal interest Page 1 of Enclosure 1 shows the latest information the NRC staff has regarding licensee plans for submitting license renewal applications. No changes to the submittal plans were identified at the meeting.
The NRC staff stated that it had met with a group of licensees to discuss the possibility of submitting a combined license renewal application for several nuclear power plants. The staff identified several regulatory and resource management concerns associated with a combined license renewal application and plans to continue discussions with this group of licensees.
The staff requested that licensees who are planning to submit a license renewal application notify the NRC as soon as possible to allow time for the NRC to budget its resources.
The staff noted that the schedule for issuing a new license has been revised from 25 months to 22 months from the receipt of a license renewal application. The staff explained that this revision is a result of the Commission delegating the authority for approving a license renewal application to the Director of the Office of Nuclear Reactor Regulation. Consequently, the NRC is considering whether to revise its internal schedules for issuance of requests for additional information (RAIs) from eight to six months.
C. Lessons learned and license renewal guidance development (1)
NRC - NEI workshop The NRC staff conducted a workshop on October 22-23, 2002, concerning implementing a new format for license renewal applications that take credit for the Generic Aging Lessons Learned (GALL) report. The staff and NEI agreed that the workshop was productive.

Generic renewal application format Mr. Tuckman, Chairman of the NEI License Renewal Working Group, stated that NEI plans to revise NEI 95-10, Industry Guideline for Implementing the Requirements of 10 CFR Part 54-The License Renewal Rule, by incorporating the license renewal application format agreed upon by the NRC and NEI, with the expectation that the NRC would endorse the revision in a regulatory guide. The staff indicated that it planned to revise the regulatory guide when it revises other generic guidance documents in 2004.

Guidance document update process The staff summarized the status of the interim staff guidance process and the deployment of an appeals process. The staff stated that it intended to revise generic guidance documents, such as the Standard Review Plan and the GALL report in 2004 to incorporate approved interim staff guidance, the revised format of the application, and other lessons learned. The staff expects to continually revise the generic guidance documents every few years.
Mr. Tuckman stated that NRC reviewers have requested that applicants commit to interim staff guidance requirements prior to the interim staff guidance being issued. He was concerned that applicants were required to commit to staff positions that had not been defined, discussed with NEI, nor approved.
The staff stated that it would work with NEI to prioritize the draft interim staff guidance, resolve the disagreements, and issue final positions. The staff stated that it shared NEIs concern that the implementation of interim staff guidance slows down the license renewal review process and committed to finalizing the interim staff guidance concerning fuse clips.
Mr. Tuckman stated that the proposed appeals process is workable if the turnaround time is shortened and differences are resolved quickly.

Environmentally assisted fatigue NEI submitted a topical report concerning environmentally assisted fatigue two years ago. The staff began its review and requested additional information. Mr. Tuckman requested that the staff stop its review of the topical, since NEI intends to submit proposed interim staff guidance regarding environmentally assisted fatigue. He requested that the staff agree to the resolution of the issue by approving and issuing the interim staff guidance.
Mr. Tuckman noted that the project managers for several of the license renewal applications had been changed during the license renewal review process. He asked that the NRC attempt to maintain stability through out the license renewal review process. The staff explained the circumstances under which the project managers had been replaced and confirmed that the NRC was concerned about maintaining continuity during the license renewal review process.
D. Public Participation No member of the public chose to provide comments during this portion of the meeting.
The next meeting between the LRSC and the NEI License Renewal Working Group will be scheduled in approximately three months.
II. Meetings between NRC Management and License Renewal Applicants A. Status of applications (1)
Virginia Electric and Power Company -- Surry, Units 1 and 2, and North Anna, Units 1 and 2 VEPCO provided an update of the progress of the Surry and North Anna license renewal application reviews (Enclosure 3). The staffs presentation materials are contained in pages 2 and 3 of Enclosure 1. The applicant stated that communication continues to be frequent, open, and productive. VEPCO pointed out that the NRC staff has completed all review milestones according to or ahead of schedule. Also, the NRC staff updated the steering committee members on the status of application reviews and pointed out that the revised 22-month review schedule has been submitted to the applicant.

Duke Energy Company -- McGuire, Units 1 and 2, and Catawba, Units 1 and 2 Duke discussed recent accomplishments in the safety and environmental reviews and provided the status of the hearing process. Duke noted that it was disappointed in the high number of new open items identified in the SER and suggested that the NRC management team consider the implication that the quality of the staffs technical review could be improved to minimize the number of late-identified open items in future application reviews. Duke also stated that two letters had been submitted to the NRC in response to the SER open items, and that a third letter would be provided this week to address additional requests for information.
Duke indicated that the Atomic Safety and Licensing Board (ASLB) requested the Commission to clarify its ruling on the partial admissibility of the severe accident mitigation alternative (SAMA) contention pertaining to Dukes failure to consider information from a direct containment heating study performed by Sandia National Laboratory and documented in NUREG/CR-6427. Duke further noted that the ASLB has temporarily suspended the hearing process pending its receipt of clarification from the Commission. Duke and the staff agreed that the presentations to the Advisory Committee for Reactor Safeguards (ACRS) in October, 2002, were well-executed and very successful.
The NRC staff added that Dukes responses to the SER open items had been received and were being reviewed by the staff. The staff also indicated that many of the open items were considered resolved. However, several of the applicants responses were not adequate to close certain open items. The staff further noted that the open items still under debate involved long-standing issues that had been the subject of significant dialogue (conference calls, requests for additional information, and meetings with the applicant). The staff expressed concern that the milestone for issuing the SER in January, 2003, may be in jeopardy because of the time and resources necessary to work out resolutions to these items. The accomplishments of the review to date, as well as future activities, are outlined on pages 4 and 5 of Enclosure 1. Dukes presentation materials are contained in Enclosure 4.

Exelon Generation Company -- Peach Bottom, Units 2 and 3 Exelon provided an update of the progress of the Peach Bottom license renewal application review (Enclosure 5). The staffs presentation materials are contained in pages 6 and 7 of. The applicant noted that the NRC aging management review inspection identified three open items, which it expected to be resolved. The applicant observed that the meeting with the ACRS went well. The applicant identified the last two open items as the adequacy of the time-limited aging analysis for the reactor vessel top guide and the appropriate aging management program for fuse holders. The applicant noted that concerns regarding the interim staff guidance on fuse clips should be resolved quickly. The staff presented the recent accomplishments and future activities associated with its review of the application.

Florida Power and Light Company -- Turkey Point 3 & 4 and St. Lucie 1 & 2 FPL provided an update of the progress of the St. Lucie, Units 1 and 2, license renewal application review (Enclosure 6). The staffs presentation materials are contained in pages 8 and 9 of Enclosure 1. The applicant identified the license renewal activities that had been completed, summarized the upcoming activities, and noted that all license renewal activities are on or ahead of schedule. The applicant provided feedback on the number and type of RAIs issued by the staff. The applicant stated that the public meetings to review draft RAIs and draft RAI responses was very effective, there is significant benefit in referencing the GALL report in the area of aging management programs, and there was little value associated with providing references to the GALL report in the license renewal component table listings. The applicant concluded that, in order for the license renewal process to remain stable and predictable, the current licensing bases, component active/passive determinations, level of detail in the license renewal application, and limited review of programs consistent with GALL must be consistently maintained. The staff noted that the applicant had been responsive to providing the information necessary to prepare the safety evaluation report.

Omaha Public Power District -- Fort Calhoun OPPD provided an update of the progress of the Fort Calhoun license renewal application review (Enclosure 7). The staffs presentation materials are contained in pages 10 and 11 of. The applicant noted the accomplishments of the safety and environmental reviews, and the expectations for future meetings with the staff. The applicant presented a graph indicating that the resources used to review the Ft. Calhoun license renewal application has been less than the resources used to review the Arkansas Nuclear One, Unit 1, application.
The staff noted that the Ft. Calhoun license renewal application was the first to follow the GALL format. The staff stated that the safety evaluation report template developed for Ft. Calhoun will be revised and applied to future license renewal applications.

Carolina Power and Light -- H.B. Robinson, Unit 2 CP&L provided an update of the progress of the H.B. Robinson license renewal application review (Enclosure 8). The staff's presentation materials are contained in pages 12 and 13 of. The applicant concluded that license renewal activities are on or ahead of schedule and that frequent communications with the staff are occurring. The staff stated that there had been no requests for intervention and that a revised 22-month schedule would be issued.

Rochester Gas & Electric -- R.E. Ginna RG&E provided an update of the progress of the R.E. Ginna license renewal application review.
The staff presentation materials are contained in pages 14 and 15 of Enclosure 1. The staff stated that there had been no requests for intervention. The staff will issue a revised 22-month schedule if no intervention requests are received.

South Carolina Electric & Gas -- Virgil C. Summer SCE&G provided an update of the progress of the Summer license renewal application review (Enclosure 9). The staff presentation materials are contained in pages 16 and 17 of. The applicant observed that the interface with the NRC has been excellent and that meetings have been valuable to both the applicant and the NRC.
