) EA 99-234 NRC STAFF RESPONSE TO OCTOBER 24, 2002 MEMORANDUM AND ORDER On October 24, 2002, the Atomic Safety and Licensing Board Panel (hereinafter Board) issued a Memorandum and Order in which it requested the parties to respond to three issues.

First, the Board requested the parties to review the List of Exhibits for accuracy. Second, the Board requested that the parties inform the Board of any necessary changes or corrections to the hearing transcript. Finally, the Board requested further briefing on the Motion to Compel filed by the Tennessee Valley Authority (hereinafter TVA) on August 22, 2002 requesting that the Nuclear Regulatory Commission (hereinafter NRC) Staff pay additional travel expenses to Wilson C.

McArthur for his hearing testimony.

EXHIBIT LIST The Staff has reviewed the List of Exhibits provided by the Board and compared that list to the list it compiled on the final day of the hearing. The Boards list is in accord with the Staffs list and the Staff has no additions or other changes to that list.

TRANSCRIPT CORRECTIONS The Staff has reviewed the complete hearing transcript. Other than typographical errors, the Staff did not note any errors or omissions in the transcript which required correction.

MOTION TO COMPEL The Staff, TVA, and Dr. McArthur have reached an agreement settling the matters raised in TVAs Motion to Compel the Staff to pay further travel expenses to Dr. McArthur. Under this agreement, TVA will withdraw its Motion to Compel in return for the Staff agreeing to reimburse travel expenses related to Dr. McArthurs deposition in December 2001.
