GINNA NUCLEAR POWER STATION - REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE
Dear Mr. Mecredy:
By letter dated September 23, 2002, Rochester Gas and Electric Corporation (RG&E) submitted an affidavit dated September 23, 2002, executed by you and requested that the following compact disc (CD-ROM) to be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.790: "... CD containing the RG&E "Review Tools"...."
The affidavit states that the submitted CD-ROM should be considered exempt from mandatory public disclosure due to the following reason: "In accordance with 10 CFR 2.790(a)(4), the methodology and technology employed to navigate from... is considered proprietary and confidential by RG&E."
We have reviewed your application and all of the supporting information in accordance with the requirements of 10 CFR 2.790 and have concluded that you have not provided sufficient justification for us to determine that the information sought to be withheld from public disclosure contains proprietary, or confidential information.
Accordingly, we have concluded that the information sought to be withheld from the public disclosure does not meet the requirements of 10 CFR 2.790. Therefore, your request to withhold the CD-ROM from public disclosure is denied.
Within 30 days from receipt of this letter, the subject CD-ROM will be placed in the Public Document Room. If, within thirty (30) days of the receipt of this letter, you request withdrawal of the CD-ROM in accordance with 10 CFR 2.790(c), your request will be considered in light of applicable statutes and regulations and a determination made whether the documents will be withheld from public disclosure and returned to you.
