[PROPOSED] ORDER GRANTING DEBTOR'S MOTION FOR VALUATION OF CLAIM FOR FEASIBILITY PURPOSES (SAMUEL ANDERSON, CLAIM NO. 178)
On October 2,2002, the motion by Pacific Gas and Electric Company, debtor and debtor in possession in this Chapter 11 case ("PG&E" or the "Debtor"), for an order valuing certain Employment Claims solely for purposes of determining the feasibility of the Plan of Reorganization Under Chapter 11 of the Bankruptcy Code for Pacific Gas & Electric Company (dated April 19, 2002) filed by PG&E and PG&E Corporation on March 7, 2002 (the "PG&E Plan") came on regularly for hearing before the Court. Accordingly, and for the reasons stated by the Court on the record of the hearing, IT IS HEREBY ORDERED that:
The Claim of Samuel Anderson, Proof of Claim No. 178, in the amount of $10 million for "wrongful termination," shall be valued at zero for purposes of determining the financial feasibility of the PG&E Plan. This valuation shall be for feasibility purposes only, shall not determine or affect the allowance of the Claim, and shall not be binding on or admissible in the Superior Court in which the Litigation is pending.
