Dear Mr. McKinley:

I am responding to your letter dated June 25, 2002, to Mr. Gary Sanborn of the U.S. Nuclear Regulatory Commissions (NRCs) Region IV office. You requested that the NRC confirm that there are no current NRC regulations prohibiting your planned development of the WNP-1 and WNP-4 sites.

The NRC regulations do not directly prohibit such development. However, the Energy Northwest Updated Final Safety Analysis Report (UFSAR) for the Columbia Generating Station (CGS) discusses the WNP-1 and WNP-4 sites. Energy Northwest is required by NRC regulations to meet their UFSAR.

Energy Northwest can revise or request a revision to their UFSAR to address any potential hazards the planned industry would have on the operating plant to protect the health and safety of the public. The extent of NRC involvement in that process will depend on the type and extent of any changes that Energy Northwest proposes to the UFSAR.

I have contacted the Department of Energy representative at the Hanford Site, and we are both in agreement that it is up to the Composite Power Corporation to contact Energy Northwest, communicate its plans and coordinate with Energy Northwest on any changes to the CGS UFSAR that may be required.
