Dear Senator Boxer:

Pacific Gas and Electric Company has applied to expand storage of high level radioactive waste onsite at its Diablo Canyon nuclear facility. As you know, Diablo Canyon is sited 2 1/2 miles from a major active earthquake fault (the'Hosgri Fault). In addition, the dry cask system proposed does not meet 9/11 criteria, nor does it solve the problem of vulnerable spent fuel pools.

Ten local organizations have filed as Intervenors to address safety and financial concerns of PG&Es proposal. In addition, the San Luis Obispo Board of Supervisors and the San Luis Harbor District filed as government participants.

Not surprisingly, PG&E's response is that none of the contentions merit full hearings. On the other band the Atomic Safety and Licensing Board (ASLB) of the Nuclear Regulatory Commission (NRC) supports two of the contentions and believes that the rest should be disallowed either because the full NRC Commissioners have failed to address 9/11 terrorist style accidents at nuclear power plants or that PG&E's bankruptcy is being heard in other proceedings.

The NRC has had II months to move towards making nuclear power facilities less vulnerable to terrorism and instead it has used its resources to promote new nuclear plants rather than adequately securing the plants sited around our country. We believe it is time for Congress to demand a General AccountingOffice investigation into the NRC's cavalier attitude toward safety of reactor communities.

Please look into this extreme safety and terrorism problem as soon as possible.
