Dear Congressman Matheson:
This letter is in response to your August 30, 2002, letter to Mr. Dennis K. Rathbun, Director, Office of Congressional Affairs, concerning documents requested by one of your constituents, Mr. Kevan Crawford. As noted in your letter, Mr. Crawford requested the following documents:
(1) all NRC notices of violations issued to Idaho State University from 1994 to the present; (2) all annual operating reports for Idaho State University reactor from 1991 to the present; (3) any Idaho State University 10 CFR 50.59 safety reviews on or after the date of initial licensing of the nuclear reactor at Idaho State University; (4) the Idaho State University reactor operations log, including checkout sheets and sample irradiation entries from Idaho State University's 1993 investigation and inspection for the dates March 3, May 21, and June 4, 1992; and (5) the voice recording of a February 15, 1993, conference call between Marvin Mendonca, Blaine Murray, and Kevan Crawford concerning the Idaho State University nuclear reactor.
We have looked for the documents Mr. Crawford requested. The results of our search are enclosed. If we cannot provide the requested documents, we explain why.

Request for Nuclear Regulatory Commission Documents The following are the results of the Nuclear Regulatory Commissions (NRCs) search for the documents requested by Mr. Crawford.
Request:
All NRC notices of violations issued to Idaho State University from 1994 to the present
Response
No notices of violations were issued to Idaho State University from 1994 to the present. An inspection report dated August 23, 1994, contained a noncited violation. The violation was not cited because the criteria in paragraph VIII.B1 of the NRCs Rules of Practice in 10 CFR Part 2, Appendix C, had been satisfied.
The violation had been corrected and measures to preclude recurrence implemented before the inspector left the site. The inspection report is attached.
Request:
All annual operating reports for the Idaho State University from 1991 to the present
Response
All of the Annual Operating Reports for the Universitys reactor from 1991 through 2001 are attached.
Request:
Any Idaho State University 10 CFR 50.59 safety reviews on or after the date of initial licensing of the nuclear reactor at Idaho State University
Response
The NRC did not find any documents that meet this description in our document search. The licensee is not required to submit 10 CFR 50.59 safety reviews to the NRC. As required by its technical specifications, the licensees annual operating reports contain summaries of the 10 CFR 50.59 reviews that were done during the year covered by the report (attached). The NRC inspects selected 10 CFR 50.59 safety reviews and associated changes to the reactor at the site.

The Idaho State University reactor operations log, including checkout sheets and sample irradiation entries from Idaho State University's 1993 investigation and inspection for the dates March 3, 1992, May 21, 1992 and June 4, 1992
Response
The NRC did not find any documents that meet this description. The NRC inspects these types of documents at the licensees site.
