INDIAN POINT NUCLEAR GENERATING UNIT NO. 2 - TERMINATION OF REVIEW RE: BEST ESTIMATE SMALL BREAK LOSS-OF-COOLANT ANALYSIS METHODOLOGY (TAC NO. MB2987)

Dear Mr. Kansler:

By letter dated August 29, 2001, Consolidated Edison Company of New York, Inc. (Con Edison) requested that the U.S. Nuclear Regulatory Commission (NRC) review the small break loss-of-coolant accident (LOCA) evaluation methodology for the Indian Point Nuclear Generating Unit No. 2 (IP2). This methodology was detailed in Westinghouse Report, WCAP-14936, Code Qualification Document for Best Estimate Small Break LOCA Analysis (Proprietary). On September 6, 2001, the license for IP2 was transferred from Con Edison to Entergy Nuclear IP2 and Entergy Nuclear Operations, Inc. (Entergy). By letter dated September 20, 2001, Entergy requested that the NRC continue to review and act upon all requests before the Commission which had been submitted by Con Edison.

In September 2001, the NRC staff discussed the scope of the review effort and the typical level of effort required by the staff and its contractor to complete this review. On the basis of the information, Entergy requested that the staff suspend, until further notice, the review of the methodology pending budgetary consideration and the resolution of certain contractual issues between Entergy and Con Edison. Since Entergy has not requested to date that the NRC restart its review of the best estimate small break LOCA evaluation methodology, the staff has decided to close out this action. Entergy will need to inform the staff in writing if it should desire that the review be reinitiated.
