DONALD C. COOK NUCLEAR PLANT, UNITS 1 AND 2 - RESPONSE TO SEPTEMBER 5, 2002, E-MAIL REGARDING THE NUCLEAR DECOMMISSIONING TRUST FUND AND THE SPENT NUCLEAR FUEL TRUST FUND FOR EACH UNIT
Dear Mr. Smith:
Thank you for your September 5, 2002, e-mail to the Nuclear Regulatory Commission (NRC) concerning the nuclear decommissioning trust fund and the spent nuclear trust fund for the Donald C. Cook Nuclear Power Plant (D. C. Cook), Units 1 and 2. Title 10 of the Code of Federal Regulations, Part 50, Section 50.75, requires that each licensee establish a decommissioning fund to assure that reasonable funds will be available for the decommissioning of each nuclear power plant. The regulation at 10 CFR 50.75 also sets a schedule for the minimum amount of funds a licensee is required to contribute to the decommissioning fund. The NRC collects data on decommissioning trust funds for each licensee every 2 years, as specified in 10 CFR 50.75(f)(1). The last report made by the Indiana Michigan Power Company (I&M), the holder of the licenses for D. C. Cook Units 1 and 2, was submitted to the NRC by letter dated March 27, 2001. In accordance with 10 CFR 50.75(f)(1), I&Ms next status report on decommissioning trust funds will be as of December 31, 2002, and will be reported to the NRC by March 31, 2003. The last data reported by I&M for indicates the amounts in the decommissioning fund as of December 31, 2000, for D. C. Cook Unit 1 is $287,038,062, and D. C. Cook Unit 2 is $253,249,588.

The March 17, 2001, letter also provided the current and projected amounts of funding for the nuclear decommissioning trust fund and the projected cost for decommissioning for each unit.
As of December 31, 2000, I&M reported the projected minimum decommissioning fund amount for D. C. Cook Unit 1 to be $319,293,450, and D. C. Cook Unit 2 to be $315,036,204, at the end of each units 40-year license. The differences are a reflection of different thermal reactor size, and the different license expiration dates of the two units.
G. Smith In your e-mail, you also requested the status of the spent fuel trust fund at D. C. Cook. This fund is not regulated by the NRC. The spent fuel trust fund is regulated by the Department of Energy (DOE). DOE will be the best source to obtain the information you requested.
