Withdrawal of 10 CFR 50.55a Request for Use of Alternative to ASME Code Requirements for the Davis-Besse Nuclear Power Station Third Ten-Year Interval Inservice Inspection Program (RR-A9; TAC No. MB 1607)
Ladies and Gentlemen:
By letter dated September 19, 2000 (Serial Number 2672), the FirstEnergy Nuclear Operating Company (FENOC) submitted the Third Ten-Year Interval Inservice Inspection (ISI) Program for the Davis-Besse Nuclear Power Station (DBNPS). Relief Request RR-A9, which was submitted as part of the ISI Program, proposed the use of ASME Code Case N-619, "Alternative Requirements for Nozzle Inner Radius Inspections for Class 1 Pressurizer and Steam Generator Nozzles."
Since the submittal of this request, the NRC staff has issued Draft Regulatory Guide DG-1 112, "ASME Code Cases Not Approved for Use," dated December 2001. The Draft Regulatory Guide states that Code Case N-619 is not acceptable to the NRC Staff because the study upon which it was based was not sufficiently broad to address all applicable plants and conditions. Additionally, the NRC Staff found the ultrasonic testing data inconclusive. Therefore, FENOC is withdrawing Relief Request RR-A9 from the NRC and will remove it from the Third Ten-Year Interval Inservice Inspection Program.
