By letter dated August 7, 2002, Southern Nuclear Operating Company (SNC) received a request from the NRC staff addressing several options for controlling classified information sent to the NRC resident's office.

SNC considered the options in your letter for storing classified information and has selected option 3. SNC reviewed several locations with the resident inspector for the two-drawer security container and determined that the best location is within the Protected Area portion of our Primary Access Point (PAP) building. SNC will add details to the security procedure for control of Safeguards Information to address the provisions stated in your letter for the control of this container and its contents.

SNC is not requesting access to classified information or other contents of the security container and is not otherwise requesting a facility or other clearance under 10 CFR Part 95. SNC recognizes that the NRC will retain exclusive control of any classified material stored at FNP and will be responsible for compliance with any security requirements associated therewith, except as expressly noted in the following paragraph.

SNC will commit to perform the following:

Once the container is in place, SNC will not move the container from this location or attempt to gain access to it. Plant procedures will be in place to require that if the container is found unlocked and unattended, the resident inspector or the NRC operations officer will be notified immediately and the contents of the container will be guarded until NRC personnel are present.

This letter contains a formal NRC commitment as described in the foregoing paragraph.
