Semiannual Fitness-For-Duty Report Ladies and Gentlemen:

In accordance with the requirements of 10CFR26.71(d), "Recordkeeping Requirements,"

the Semiannual Fitness for Duty Report is being submitted for the Perry Nuclear Power Plant. This report covers the time period of January 1, 2002 to June 30, 2002. provides the Fitness for Duty Program performance data regarding testing results. Attachment 2 provides additional information regarding management actions taken in response to positive results, initiatives taken by the Fitness for Duty Program, and Reported Events. The provisions of the Fitness for Duty Program apply to persons granted unescorted access to the Protected Area of the plant, as well as to licensee, vendor, and contractor personnel required to physically report to the Technical Support Center or the Emergency Operations Facility in accordance with the Emergency Plan and associated implementing procedures.

Note: Under the heading of Marijuana, the number above the slash, indicates the number of tests deemed positive at the DHH/NRC cut-off level (1O0ng). The number below the slash indicates the number of tests that were deemed positive at the Perry Plant's more conservative cut-off level (50ng).

The licensee employee, testing positive for alcohol during random testing was denied access to the Protected Area. Pursuant to Nuclear Operating Procedure (NOP-LP-1 002) "Fitness for Duty Program" requirements, the individual and/or their company representative were informed of the right to appeal, and of the procedural requirements in order to reinstate unescorted access to the Protected Area. This individual has completed all procedural requirements and unescorted access has been reinstated.

The three contractor employees testing positive for illegal drugs during pre-access testing were denied access to the Protected Area. Pursuant to Nuclear Operating Procedure (NOP-LP-1 002)

"Fitness for Duty" requirements, the individuals and/or their company representative were informed of the right to appeal, and of the procedural requirements in order to establish unescorted access to the Protected Area. To date, none of the affected individuals have initiated steps to establish unescorted access.

Additionally, one contractor employee, who did not have unescorted access and was not in processing for unescorted access, consented to For Cause testing based on observed behavior.

At no time did the contractor enter the Protected Area prior to this observation. The test resulted in a positive alcohol result. Based on this the contractor was removed from site. This incident was not captured in the Performance Data Report statistics due to being outside the scope of 10 CFR 26.

Eight (8) individuals were subjected to unannounced follow-up testing during this reporting period, as a result of a Fitness for Duty Program concern.

Initiatives Taken Perry's Fitness for Duty Program has taken responsibility for the Overtime Guidelines Program.

This ownership will help in establishing consistency in oversight and implementation of the program. Site communications were distributed re-emphasizing program requirements, such as ensuring fitness for duty suitability prior to authorizing overtime hours.
