SUBJECT:
SUMMARY
OF LICENSE RENEWAL MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION (NRC) STAFF AND THE NEI LICENSE RENEWAL WORKING GROUP; VEPCO FOR THE SURRY AND NORTH ANNA POWER STATIONS, UNITS 1 AND 2; DUKE FOR THE MCGUIRE AND CATAWBA NUCLEAR STATIONS, UNITS 1 AND 2; EXELON FOR THE PEACH BOTTOM ATOMIC POWER STATION, UNITS 2 AND 3; FLORIDA POWER AND LIGHT FOR THE ST. LUCIE, UNITS 1 AND 2; AND OPPD FOR THE FORT CALHOUN STATION A joint meeting was held on July 23, 2002, to discuss the status of license renewal activities.
The meeting began with discussions between the NRCs License Renewal Steering Committee (LRSC) and NEIs License Renewal Working Group on the general status of license renewal applications and generic license renewal activities. The meeting continued with discussions between NRC management and VEPCO (Surry and North Anna), Duke (McGuire and Catawba), Exelon (Peach Bottom), FPL (St. Lucie), and OPPD (Fort Calhoun) regarding the progress of the license renewal application reviews. The meeting agenda and the NRC staffs presentation materials are contained in Enclosure 1. Attendees at the meeting are listed in. A summary of the discussions held at the meeting follows.
I.
Meeting between the NRC License Renewal Steering Committee and NEI License Renewal Working Group A. Status of applications VEPCO, Duke, Exelon, FPL, and OPPD provided summaries of the Surry, North Anna, McGuire, Catawba, Peach Bottom, St. Lucie, and Fort Calhoun license renewal application reviews, which were subsequently discussed in more detail during the management portion of the meeting (see summaries below). FPL reported that the renewed licenses for Turkey Point, Units 3 and 4, were issued on June 6, 2002. A license renewal application for Robinson Unit 2 was also received by the NRC on June 17, 2002.
B. License renewal interest Page 2 of Enclosure 1 shows the latest information the NRC has regarding licensee plans for submitting license renewal applications. No changes to the submittal plans shown were identified at the meeting. NEI noted that by August 2002, approximately 25 percent of the U.S.
plants will have either received renewed licenses or be under review by the NRC for renewal.
Renewal applications for Ginna and Summer are scheduled to be received in August 2002.
NEI indicated that it continues to emphasize to licensees the importance of notifying the NRC as soon as possible of their renewal plans.
As indicated on Page 1 of Enclosure 1, the NRC expects schedule and resource challenges with unique applications planned to be submitted when compared to the review of standard renewal applications received to date. The renewal application for Millstone, Units 2 and 3, will involve the review of two different reactor designs and associated systems between Unit 2 (Combustion Engineering) and Unit 3 (Westinghouse). The Nine Mile Point, Units 1 and 2, review involves two different boiling water reactor and containment designs. Unit 1 is a BWR 2, Mark 1, and Unit 2 is a BWR 5, Mark 2.
The renewal application for Browns Ferry, Units 1, 2, and 3, will be under review in conjunction with reviews and inspections to restart Unit 1 and reviews for extended power uprates. This will result in an evolving current licensing basis for Unit 1 during the renewal review. Currently, the staff has only scheduled and budgeted resources for a normal, two-unit renewal application for Units 2 and 3 (submittal in December 2003). The Tennessee Valley Authoritys (TVAs) plans for submittal of one renewal application for all three units were subsequently discussed between the NRC staff and TVA at a meeting on July 24, 2002.
Efficiencies are still expected for the review of multiple units in a combined application for these unique applications, but the effort may exceed that of an application where the design of all of the units is essentially the same. The staff will assess any impacts on schedule and resource needs for these unique applications as application-specific information becomes available.
C. License renewal implementation guidance development (Page 3 of Enclosure 1)
The NRC staff plans to initiate a formal revision of the implementation guidance (license renewal regulatory guide, standard review plan, and Generic Aging Lessons Learned (GALL)
Report) in 2003, with issuance in 2004. Until then, the staff will continue to develop interim staff guidance (ISGs) (see Item I.D(2) below), for use by industry and interested stakeholders until the ISGs can be incorporated into the revised guidance documents. The staff plans to conduct a public workshop on October 22-23, 2002, to discuss lessons learned from the application reviews and the use and update of the renewal guidance documents.

Environmentally assisted fatigue NEI submitted for review on June 5, 2001, EPRI Technical Report, Guidelines for Addressing Fatigue Environmental Effects for License Renewal Application (MRP-47). The staff issued a request for additional information (RAI) on June 26, 2002. Assuming that NEI can respond to the request by August 26, 2002, the staff plans to issue its final safety evaluation by February 1, 2003. NEI stated that they have the information needed to resolve this issue for low alloy and carbon steel materials and will request an August 2002 meeting to discuss the information with the staff. More test data is required for stainless steel materials, which will be addressed next year.

Station blackout scoping The ISG, which specifies that components credited for recovery from a station blackout event should be included in scope for license renewal aging management review, was resolved.
Although industry does not fully agree with the position, applicants will follow the revised guidance. However, for plants with renewed licenses, the NRCs project managers asked the licensees if they planned to implement the new position. NEI believes that the NRC should follow its backfit procedures and not request the licensees to respond informally. The LRSC agreed and indicated that the guidance for implementing ISGs (see Item I.D.(2) below), will include an assessment of the impact on previously renewed licenses and the need for backfitting, in accordance with the provisions of 10 CFR 50.109.
D. Lessons learned from application reviews (Page 3 of Enclosure 1)

Fort Calhoun lessons learned The Fort Calhoun renewal application was the first application received that was prepared and will be reviewed in accordance with the latest editions of the license renewal standard review plan and GALL report. The need for improved guidance was identified to better link the scoping and screening results to the aging management review. This issue was resolved for the Fort Calhoun application by OPPDs submittal of supplemental information. The staff will document the lessons learned from the Fort Calhoun review and issue it as an ISG. NEI requested that the ISG be issued as soon as possible for use by licensees who are preparing applications for submittal in 2003.

Interim staff guidance process The NRC staff has developed an ISG process to document lessons learned from the demonstration project and the ongoing license renewal application reviews. ISGs are intended to provide guidance in the interim until the applicable guidance document (regulatory guide, standard review plan, or GALL report) can be updated. Anyone, including staff, industry, or other interested stakeholders, can initiate an ISG. Once a proposed position is developed, the staff issues the ISG for comment to NEI and the Union of Concerned Scientists (acting as a coordinator for public interest groups). When the comments are resolved and the ISG is established, the ISG can be used by applicants and other interested stakeholders. The Committee to Review Generic Requirements will review these staff positions during its review of the guidance document revision, into which the ISGs are incorporated.
ISGs developed from ongoing reviews may, in some cases, establish positions requiring implementation by licensees who have already received renewed licenses. The staff will follow the procedures established in accordance with 10 CFR 50.109 for backfitting new requirements on existing licensees. There is time to resolve these backfit issues for plants with renewed licenses, as the revised position would not be applicable until the extended period of operation (after year 40). Sufficient time exists to establish the process and coordinate it with the industry and other interested stakeholders before a plant with a renewed license reaches 40 years.

Appeal process The NRC owes NEI a response to its proposed appeal process contained in NEI letter dated December 4, 2001. The staff has been evaluating NEIs proposed process and currently intends to follow the NRCs process discussed with NEI in previous meetings. This process involves using the NRC management chain with ascending levels of appeal if an issue cannot be resolved. The NRCs LRSC would be kept informed of issues under appeal. The NRC staff will respond by letter to NEIs proposal.

Additional topics discussed NEI stated that the license renewal process has been successful. However, NEI emphasized that, to continue that success, the staff needs to ensure that the experience gained, to date, is transferred to new staff reviewers and contractors that are being brought into the process. The staff recognizes the need for reviewers to have the required experience, and plans additional training for reviewers and contractors, where needed.
Regarding the need for regulatory stability, NEI indicated that the applicants who have submitted their second renewal application (Duke and FPL) have seen changes in regulatory positions between the two reviews. NEI suggested that the NRC staff consider performing a self-assessment. Duke stated that it will provide the staff with examples of what it considers changed positions to allow discussions to begin on the industrys concern. The NRC staff indicated that it will consider NEIs suggestion and the examples to evaluate where regulatory positions may have changed. However, the staff also noted that both the Commission and the industry expect to improve the license renewal process using lessons learned. This may result in changes in some regulatory positions as more experience is gained during the review of more applications.
NEI stated that all of the applicants find the staffs process of coordinating draft RAIs with the applicant before formally issuing them to be beneficial. The staff responded that this coordination is part of the renewal process and will continue.
E. Public Participation No member of the public chose to participate in this portion of the meeting.
The next meeting between the LRSC and the NEI License Renewal Working Group will be scheduled in approximately three months.
II. Meetings between NRC Management and License Renewal Applicants A. Status of applications (1)
Virginia Electric and Power Company -- Surry 1 & 2 and North Anna 1 & 2 VEPCO provided an update of the progress of the Surry and North Anna license renewal application reviews (Enclosure 3). The applicant stated that communication continues to be frequent, open, and productive. VEPCO pointed out that the change in the NRC safety and environmental review project managers has not affected the review schedule and the NRC staff has met or exceeded all schedule milestones. A meeting between the applicant and the NRC staff has been scheduled for August 5, 2002, to discuss any changes or potential improvements in the review schedule. Also, the NRC staff updated the steering committee members on the status of application reviews and future milestones (pages 4 and 5 of Enclosure 1).

Duke Energy Company -- McGuire 1 & 2 and Catawba 1 & 2 Duke discussed recent accomplishments in the safety and environmental reviews and the hearing process, indicating that responses to the staffs RAIs were provided by April 15, 2002.
Duke noted that it had received and responded to a letter that delineated a list of potential open items for the safety evaluation report (SER), and that the number of potential items (29) seemed rather high.
Duke indicated that the Commission had reversed one of two contentions (proffered by Nuclear Information & Resource Service and the Blue Ridge Environmental Defense League) for hearing. The reversed contention pertained to the potential use of mixed-oxide fuel at the McGuire and Catawba nuclear stations. The Commission had not responded at the time of the meeting to an appeal by Duke and the staff on the contention pertaining to severe accident mitigation alternatives. (Subsequent to the meeting, the Commission issued the order, CLI 02-17, admitting, to an extent, the contention.) Duke also indicated that the Atomic Safety and Licensing Board was currently holding conference calls to determine if eight late-filed contentions are admissible.
The NRC staff added that Dukes response to the potential open items letter enabled the staff to close most of the confirmatory items, identified therein, and several open items. The staff also indicated that seven or eight similar open items had been combined into two open items, further reducing the number of open items. However, the staff also noted that a number of new open items had been identified late in the staffs review and that the total number of open items was, again, around 30. The accomplishments of the review to date, as well as future activities, are outlined in pages 6 and 7 of Enclosure 1. Dukes presentation materials are contained in.

Exelon Generation Company -- Peach Bottom 2 & 3 Exelon provided an update of the progress of the Peach Bottom license renewal application review (Enclosure 5). The staffs presentation materials are contained in pages 8 and 9 of. The applicant stated that the staff has issued environmental and safety RAIs.
The applicant provided responses to the environmental RAIs on January 30, 2002, and safety RAIs by May 22, 2002. The applicant noted the following upcoming 2002 activities: public meeting to discuss the draft supplemental environmental impact statement (SEIS) on July 31; a public exit meeting on the aging management review inspection on August 15; issuance of the SER with open items by September 16; and an Advisory Committee on Reactor Safeguards subcommittee meeting to review the SER with open items on October 30. Exelon stated that emerging issues are challenging the stability and predictability of the license renewal process.
The applicant summarized that communications with the staff have been good.

Florida Power and Light Company -- Turkey Point 3 & 4 and St. Lucie 1 & 2 FPL noted that the NRC issued the renewed licenses for Turkey Point, Units 3 and 4, on June 6, 2002. The applicant provided an update of the progress of the St. Lucie, Units 1 and 2, license renewal application review (Enclosure 6). The staffs presentation materials are contained in pages 10 and 11 of Enclosure 1. The NRC staff has completed its onsite scoping and screening methodology audit and has issued RAIs concerning the safety review. Also, the NRC staff has issued RAIs concerning the environmental review and the applicant has provided responses. The applicant discussed the milestones for issuing all of the RAIs for the safety review, issuing responses to the RAIs, conducting scoping and screening inspections, and issuing the draft SEIS. In summary, the applicant noted that license renewal activities are on schedule, communications between FPL and the NRC are frequent, and that FPL plans to provide feedback concerning the safety RAIs at the next meeting.

Omaha Public Power District -- Fort Calhoun OPPD provided an update of the progress of the Fort Calhoun license renewal application review (Enclosure 7). The staffs presentation materials are contained in pages 12 and 13 of. The staff and OPPD noted the accomplishments over the several months for the review of the LRA for FCS. The staff and OPPD have met or exceeded all scheduled milestones to date.
OPPD and the staff noted that OPPD provided the supplemental LRA information requested by the staff, that the 25-month revision to the schedule was provided (no requests for hearing or petition for leave to intervene were received), and that the environmental scoping audit and public meeting went smoothly. In addition, the staffs scoping and screening methodology audit was conducted and the staff found OPPDs methodology to be in accordance with the license renewal rule. The staff also prepared initial drafts of RAIs and provided them to OPPD for review and discussion. Communications between OPPD and the staff were characterized as good and the process, to date, has been efficient, effective, and productive.
Future activities include issuing the last environmental and safety RAIs, responding to the RAIs, and conducting the scoping inspection in November 2002. In addition, OPPD stated that they plan to request a fee reduction based on the generic benefit to the staff from the review of the Fort Calhoun application. The Fort Calhoun application is the first to be submitted that was prepared in accordance with, and will be reviewed using the license renewal standard review plan and GALL report.
