REVIEW OF REVISED INDUSTRY GUIDANCE RELATED TO INTERIM SAFEGUARDS AND SECURITY COMPENSATORY MEASURES
Dear Mr. Beedle:
The U.S. Nuclear Regulatory Commission (NRC) issued Orders dated February 25, 2002, to all operating commercial nuclear power plants to immediately implement interim safeguards and security compensatory measures. The Orders for each plant included an attachment containing safeguards information which detailed the specific interim compensatory measures (ICMs).
Following issuance of the Orders, the Nuclear Energy Institute (NEI) developed a draft industry guidance document to facilitate licensee implementation and to achieve a common understanding of acceptable methods for compliance with the ICMs in the Order. This guidance document was the subject of discussion during various meetings held between NRC and NEI in February and in March 2002. These discussions culminated in the submission of a revised NEI guidance document by letter dated March 8, 2002. On March 11, 2002, the NRC informed NEI that it found the NEI guidance dated March 8, 2002, provided an acceptable method for licensee implementation of the ICMs.
On April 8, 2002, NRC held a closed meeting with NEI and industry representatives to discuss in detail the NEI guidance document. As a result of discussions with the industry during the meeting, NEI agreed to further revise its guidance document to incorporate new insights and to include amplifying guidance relative to certain aspects of the ICMs. NRC provided comments on draft revisions of the industry guidance forwarded by NEI under letters dated May 14, 2002 and May 29, 2002.
On July 24, 2002, NEI provided for NRC endorsement Revision 1 of its industry guidelines for assessing and responding to the safeguards and security ICMs. NRC has reviewed this latest version of the industry guidance and has determined that it provides an acceptable method for licensee implementation of the ICMs.
As discussed in the Order cover letters, the Orders do not obviate the need for licensees to continue to meet the objectives of Security Level III described in NRC Information Notice 98-35, Threat Assessments and Consideration of Heightened Physical Protection Measures, and to maintain the effectiveness of existing security measures taken in response to the events of September 11, 2002.
