ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a WHITE Significance Determination Process (SDP) finding and associated Notice of Violation will be issued on or around July 30, 2002, to Omaha Public Power District, as a result of inspections at the Fort Calhoun Station. This WHITE finding, an issue with low to moderate importance to safety, which may require additional NRC inspections, involved a failure to prevent radiation levels from exceeding the Department of Transportation (DOT) limit of 200 millirem per hour at any point on the external surface of a radioactive waste shipment package. This failure was identified as a violation of 10 CFR 71.5, which requires that licensees transporting licensed materials meet the DOT radiation limits for packages, and 49 CFR 173.441(a), which contains the referenced DOT limit.
It should be noted that the licensee has not been specifically informed of this action. The schedule of issuance and notification are:
