VIRGINIA ELECTRIC AND POWER COMPANY NORTH ANNA POWER STATION UNITS I AND 2 WITHDRAWAL OF PROPOSED LICENSE AMENDMENTS ELIMINATION OF SEISMIC EFFECTS FROM CONTROL ROD DROP TIMES In letters dated June 22, 2000 and July 26, 2001 (Serial Nos.00-307 and 01-359),

Virginia Electric and Power Company (Dominion) requested amendments to the Facility Operating Licenses NPF-4 and NPF-7 for North Anna Power Station Units 1 and 2, respectively.

The proposed change was a risk-informed request to eliminate from analytical consideration the effects of a seismic event that specifically occurs concurrent with a reactor trip when assessing if measured rod drop times meet Technical Specification limits.

In a June 26, 2002, telephone conference call with the NRC staff (i.e., Messrs.

Monarque, Martin, Reinhart and O'Neal) we were informed that (1) a risk-informed submittal would require additional information for processing, and (2) NRC approval was not considered to be necessary for this change. Specifically, the NRC staff identified the 10 CFR 50.59 process as a more appropriate method that could be used to make this change to the facility design and licensing basis.

Accordingly, Dominion has reconsidered its initial submittal and is withdrawing the request for a license amendment. Based on the NRC guidance provided above, we intend to eliminate from analytical consideration the effects of a concurrent seismic event on control rod drop times by means of 10 CFR 50.59.
